AN ACT

 

1Amending the act of March 24, 1905 (P.L.50, No.35), entitled,
2"An act to reorganize the Board of Trustees of The
3Pennsylvania State College," further providing for the Board
4of Trustees.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1.  Section 1 of the act of March 24, 1905 (P.L.50,
8No.35), entitled, "An act to reorganize the Board of Trustees of
9The Pennsylvania State College," amended June 24, 1939 (P.L.863,
10No.367), is amended to read:

11Section 1.  Be it enacted, &c., That, in addition to the
12present elective members of the Board of Trustees of The
13Pennsylvania State College, the said Board shall consist of the
14following members, to wit: Three members to be elected each
15year, for a term of three years each, by the alumni of said
16college; and two members to be appointed each year, for a term
17of three years each, by the Governor of the Commonwealth, and
18confirmed by the Senate [; and the following members to serve

1ex-officio during their respective terms of office: The Governor
2of the Commonwealth, the President of the College, the State
3Superintendent of Public Instruction, the Secretary of
4Agriculture, and the Secretary of Mines].

5(1)  The Governor, the Secretary of Education, the Secretary
6of Agriculture and the Secretary of Conservation and Natural
7Resources shall serve ex officio during their respective terms.

8(2)  Board members shall serve as voting members ex officio,
9except the Governor, who shall serve as a nonvoting member ex
10officio.

11(3)  No person who has served in the capacity of the
12Governor, Lieutenant Governor, Attorney General, Auditor General
13or State Treasurer shall be permitted to serve on the Board of
14Trustees as a voting member until at least four years have
15elapsed following his official departure from that office.

16Section 2.  Section 3 of the act is amended to read:

17Section 3.  [The officers of the Board shall be chosen
18annually, to serve for a period of one year each; and shall be a
19President, a Vice-President, a Secretary, a Treasurer, and an
20Executive Committee of not less than three nor more than seven
21members, whose duty it shall be, under the direction and subject
22to the approval of the Board of Trustees, to transact such
23necessary business as may arise in the intervals between regular
24meetings of the Board. No member of the Board shall receive
25compensation for his services; but shall be paid necessary
26traveling and hotel expenses actually incurred in the
27performance of duty as such member. The Treasurer shall not be a
28member of the board, and shall give such bonds for the faithful
29performance of his duties, and receive such compensation as the
30Board may, from time to time, direct.] (a)  The officers of the 

1Board shall be elected annually, to serve for a one-year term 
2and shall include a chair, a vice-chair, a secretary, a 
3treasurer and an executive committee of not less than three nor 
4more than seven members, whose duty it shall be, under the 
5direction and subject to the approval of the Board of Trustees, 
6to transact such necessary business as may arise in the 
7intervals between regular meetings of the Board. No member of 
8the Board shall receive compensation for his services but shall 
9be paid necessary traveling and hotel expenses actually incurred 
10in the performance of duty as such member. The treasurer shall 
11not be a member of the Board, and shall give such bonds for the 
12faithful performance of his duties, and receive such 
13compensation as the Board may, from time to time, direct.

14(b)  The President of the college shall be prohibited from
15serving as an officer of the Board of Trustees, and shall also
16be prohibited from serving on the executive committee, any
17standing committee, special committee or subcommittee of the
18Board.

19Section 3.  The amendments of sections 1 and 3 of the act
20shall be applicable to both current and prospective members of
21The Pennsylvania State University Board of Trustees.

22Section 4.  This act shall take effect in 60 days.
