AN ACT

 

1Amending Title 34 (Game) of the Pennsylvania Consolidated
2Statutes, further providing for regulated hunting grounds
3permits.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 2928(a), (f), (g) and (h) of Title 34 of
7the Pennsylvania Consolidated Statutes are amended to read:

8§ 2928.  Regulated hunting grounds permits.

9(a)  Eligibility.--Regulated hunting grounds require a
10minimum of 100 acres of land, or land and water combined, on
11which the permittee must release one of the following species of
12domestically produced game birds: namely, ringneck pheasants,
13bobwhite quail or mallard ducks. Any of the listed species and
14chukar partridges may be released only if they are listed on the
15permit application and propagated by the permittee or received
16from a legal source.[At least 100 of each species listed on the
17permit shall be released.]

1(f)  Tagging killed birds.--[Before] Except for chukar 
2partridges, before any released bird killed under the provisions
3of a regulated hunting grounds permit is consumed on the
4premises or removed from the premises, the permittee shall
5attach a tag to one leg of each bird killed. The tags shall be
6numbered consecutively and supplied by the commission at
7reasonable cost and shall contain such information as the
8commission may require. [No game bird killed on a regulated
9hunting ground shall have the right foot removed until a
10regulated hunting ground tag for the current season is attached
11to the bird.] The tags shall remain attached to the individual
12birds until prepared for consumption and shall not be used more
13than once.

14(g)  Dog training and trials.--Dogs may be trained or field
15trials may be held at any time of the year upon the premises
16covered by a regulated hunting grounds permit, and retriever
17trials may be conducted thereon. All game birds killed shall be
18included in the reported kill. Except during the open season for
19shooting, no game birds or chukar partridges shall be killed
20while training dogs or conducting field trials on commercial 
21regulated hunting grounds. The special permit required in this
22title shall first be obtained to conduct a retriever trial
23thereon at any other period.

24(h)  Unlawful acts.--It is unlawful to:

25(1)  Remove from or consume on the premises covered by a
26regulated hunting grounds permit pheasants, bobwhite quail or
27mallard ducks killed in accordance with the provisions of
28this section which have not been tagged as required by this
29section.

30(2)  Violate any of the provisions of this chapter

1regarding marking and tagging of birds.

2(3)  Use any methods to hunt for, chase or kill birds on
3a regulated hunting ground which are not specifically
4permitted by this title.

5(4)  Trap any game bird or have any trap set that is
6capable of taking a game bird alive on any regulated hunting
7grounds unless authorized by this title.

8[(5)  Hunt for or take any game on a three-day hunting
9license other than permitted by subsection (d).]

10(6)  Violate any of the other provisions of this section.

12Section 2.  This act shall take effect in 60 days.
