AN ACT

 

1Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2Statutes, in general provisions, providing for cost-benefit
3analysis; and, in procurement organization, further providing
4for powers and duties of Department of General Services.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1.  Title 62 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 109.  Cost-benefit analysis.

10(a)  General rule.--Except as otherwise provided under
11subsection (b), a contract involving property, real, personal or
12mixed of any kind or description or any contract for personal
13services where the consideration involved is $50,000 or more
14shall not be implemented and no supplies, services or
15construction may be accepted or work begun until a cost-benefit
16analysis of the contract is completed by the purchasing agency.

17(b)  Applicability.--The provisions of subsection (a) shall
18not apply where:

19(1)  there is a threat to public health, welfare or

1safety; or

2(2)  there are circumstances outside the control of the
3Commonwealth agency that create an urgency of need that does
4not permit the delay involved for the completion of a cost-
5benefit analysis.

6(c)  Publication of cost-benefit analysis.--The purchasing
7agency shall file with the Treasury Department a copy of the
8cost-benefit analysis prepared under this section. The analysis
9shall be available for inspection at no charge with the
10corresponding contracts on the Treasury Department's publicly
11accessible Internet website as required under section 1702 of
12the act of February 14, 2008 (P.L.6, No.3), known as the Right-
13to-Know Law.

14Section 2.  Section 321 of Title 62 is amended by adding a
15paragraph to read:

16§ 321.  Powers and duties.

17Except as otherwise specifically provided in this part, the
18department shall have the following powers and duties:

20(7)  Complete a cost-benefit analysis of each contract
21awarded when the department acts as the purchasing agency.

22Section 3.  This act shall take effect in 60 days.
