AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for the <-definition of definitions 
3of "emergency vehicle" and "fire department <-vehicle." 
4vehicle"; and further providing for requirement for<- 
5commercial driver's license.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

<-8Section 1. The definition of "fire department vehicle" in
9section 102 of Title 75 of the Pennsylvania Consolidated
10Statutes is amended to read:

<-11Section 1. The definitions of "emergency vehicle" and "fire
12department vehicle" in section 102 of Title 75 of the
13Pennsylvania Consolidated Statutes are amended to read:

14§ 102. Definitions.

15Subject to additional definitions contained in subsequent
16provisions of this title which are applicable to specific
17provisions of this title, the following words and phrases when

1used in this title shall have, unless the context clearly
2indicates otherwise, the meanings given to them in this section:

<-4"Emergency vehicle." A State or county emergency management 
5vehicle, fire department vehicle, police vehicle, sheriff 
6vehicle, ambulance, advanced life support squad vehicle, basic 
7life support squad vehicle, emergency canteen support service 
8organization vehicle, blood delivery vehicle, human organ 
9delivery vehicle, hazardous material response vehicle, armed 
10forces emergency vehicle, one vehicle operated by a coroner or 
11chief county medical examiner and one vehicle operated by a 
12chief deputy coroner or deputy chief county medical examiner 
13used for answering emergency calls, a vehicle owned by or leased 
14to a regional emergency medical services council that is used as 
15authorized by the Department of Health to respond to an actual 
16or potential disaster, mass casualty situation or substantial 
17threat to public health, a vehicle owned by a county or regional 
18police association and operated by a police officer that is used 
19for police transport or victim extraction, any vehicle operated 
20by a special agent, special agent supervisor, narcotics agent or 
21narcotics agent supervisor while performing official duties as 
22employees of the Office of Attorney General, any vehicle owned 
23and operated by the Philadelphia Parking Authority established 
24in accordance with 53 Pa.C.S. Ch. 55 (relating to parking 
25authorities) and used in the enforcement of 53 Pa.C.S. Ch. 57 
26(relating to taxicabs and limousines in first class cities), or 
27any other vehicle designated by the State Police under section 
286106 (relating to designation of emergency vehicles by 
29Pennsylvania State Police), or a privately owned vehicle used in 
30answering an emergency call when used by any of the following:

1(1) A police chief and assistant chief.

2(2) A fire chief, assistant chief and, when a fire
3company has three or more fire vehicles, a second or third
4assistant chief.

5(3) A fire police captain and fire police lieutenant.

6(4) An ambulance corps commander and assistant
7commander.

8(5) A river rescue commander and assistant commander.

9(6) A county emergency management coordinator.

10(7) A fire marshal.

11(8) A rescue service chief and assistant chief.

12(9) The chief or operations director of a county
13hazardous materials response team.

15"Fire department vehicle." A vehicle:

16(1) owned or leased by an organized paid or volunteer
17fire department; or

18(2) owned or leased by a fire relief association and 
19utilized by an organized paid or volunteer fire department.

<-21Section 2. Section 1606(b)(7) of Title 75 is amended to
22read:

23§ 1606. Requirement for commercial driver's license.

25(b) Exemptions.--The following persons are not required to
26obtain a commercial driver's license in order to drive the
27commercial motor vehicle specified:

29(7) An employee of the State emergency management agency 
30or a county emergency management organization who is the

1holder of a Class C license and who has a certificate of
2authorization from the head of the State emergency management 
3agency or a county emergency management organization while
4operating any emergency vehicle equipped with audible and
5visual signals registered to the Commonwealth, State 
6emergency management agency, county or county emergency
7management organization.

9Section <-2 3. This act shall take effect immediately.
