AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for the registered gross weight
3limit of certain registration plates.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Sections 1307(a.1), 1338(a), 1341, 1342(a), (c)
7and (d), 1346, 1348, 1350, 1350.1, 1351, 1352, 1353, 1354(a),
81355, 1356, 1357, 1358, 1359(a), 1360, 1362 and 1363 of Title 75
9of the Pennsylvania Consolidated Statutes are amended to read:

10§ 1307.  Period of registration.

12(a.1)  Seasonal registration.--Upon application on a form
13prescribed by the department, the owner or lessee of a passenger
14car, recreational motor vehicle, motorcycle, truck or farm
15vehicle which does not have a gross vehicle weight rating of
16more than [10,000] 14,000 pounds may register the vehicle with
17the department for a period of successive months of less than
18one year. The applicant shall specify the period of months

1during which the vehicle shall be registered. Except when the
2department initially converts a currently valid annual
3registration to a seasonal registration, the annual fee
4prescribed for the vehicle by Chapter 19 (relating to fees)
5shall be paid in full by the applicant regardless of the number
6of months chosen for registration by the applicant. Upon receipt
7of the appropriate fee and the properly completed form,
8including all information required by this chapter, the
9department shall issue a seasonal registration that shall expire
10on the last day of the expiration month chosen by the
11registrant. No insurer of a vehicle belonging to any owner or
12lessee who obtains a seasonal registration and who applies for
13or receives a reduced automobile insurance premium on account
14thereof shall be required to provide any contractual coverage,
15whether in the form of the provision of a defense or the payment
16of first-party or third-party benefits or otherwise, to the
17owner or lessee in connection with any event occurring during
18that part of the year in which the vehicle is not registered;
19and such owner or lessee shall be treated for all purposes,
20including, without limitation, ascertaining rights to stack
21coverages and to uninsured and underinsured motorist coverage,
22as a person who does not own that vehicle and has no duty to
23carry financial responsibility on it for that part of the year.

25§ 1338.  Person with disability plate and placard.

26(a)  Person with disability plate.--On the application of any
27person who:

28(1)  is blind;

29(2)  does not have full use of an arm or both arms;

30(3)  cannot walk 200 feet without stopping to rest;

1(4)  cannot walk without the use of, or assistance from,
2a brace, cane, crutch, another person, prosthetic device,
3wheelchair or other assistive device;

4(5)  is restricted by lung disease to such an extent that
5the person's forced (respiratory) expiratory volume for one
6second, when measured by spirometry, is less than one liter
7or the arterial oxygen tension is less than 60 mm/hg on room
8air at rest;

9(6)  uses portable oxygen;

10(7)  has a cardiac condition to the extent that the
11person's functional limitations are classified in severity as
12Class III or Class IV according to the standards set by the
13American Heart Association;

14(8)  is severely limited in his or her ability to walk
15due to an arthritic, neurological or orthopedic condition; or

16(9)  is a person in loco parentis of a person specified
17in paragraph (1), (2), (3), (4), (5), (6), (7) or (8);

18the department shall issue a special registration plate for one
19passenger car or truck with a registered gross weight of not
20more than [10,000] 14,000 pounds, designating the vehicle so
21licensed as being used by a person with a disability. Special
22plates for persons with disabilities may also be issued for
23vehicles operated exclusively for the use and benefit of persons
24with disabilities. In the case of a motorcycle, the department
25shall issue a decal containing the international symbol for
26access for persons with disabilities for display on the
27registration plate.

29§ 1341.  Special registration plates generally.

30Upon request by the applicant, the department may issue

1registration plates consisting of any combination of numbers,
2letters or numbers and letters. These special plates may be
3issued for special groups or for special purposes and bear an
4appropriate designation. Special groups may charge a fee for
5authorization to request a registration plate bearing the name
6of the group. They shall have the same force and effect as
7regular registration plates. The department may refuse any
8combination of letters and numbers for cause and shall adopt
9reasonable rules and regulations for the issuance of the plates
10and for carrying out the provisions of this section. The
11applicant shall comply with all laws and regulations pertaining
12to registration including the payment of any additional fees.
13The department is authorized to reissue a combination of numbers
14or letters for a personal plate if the department records reveal
15that no activity, such as renewal or transfer of the personal
16registration plate, has occurred for a period of five or more
17consecutive years and provided that the personal registration
18plate was never reported as lost or stolen. Whenever the
19department reissues an inactive personal plate, the department
20may purge its records of all references to the previous owners
21of that personal plate. The department shall, however, note upon
22its records the reissuance of the personal plate and to whom the
23plate was issued. The special registration plate may be used
24only on a passenger car or truck with a registered gross weight
25of not more than [10,000] 14,000 pounds. If the vehicle is
26licensed to a business that is not a member of the special
27group, the department shall issue the plate as long as the
28business owner or officer making application is a member of that
29group.

30§ 1342.  Veteran plates and placard.

1(a)  Severely disabled veteran plate.--On the application of
2a veteran whose service-connected disability is certified at
3100% by the service unit of the armed forces in which the
4veteran served or by the United States Veterans' Administration
5or who has a service-connected disability of the type enumerated
6in section 1338 (relating to person with disability plate and
7placard), the department shall issue a special registration
8plate designating the vehicle as belonging to a severely
9disabled veteran. The registration plate shall have a white
10background, shall have blue numbers or letters as the department
11may determine, shall have the words "disabled veteran" in at
12least ten-point bold type inscribed in red at the bottom of the
13plate and shall include the international symbol for access for
14persons with disabilities. Only one special registration plate
15shall be issued to a veteran under this section. It may be used
16only on a passenger car or truck with a registered gross weight
17of not more than [10,000] 14,000 pounds. In the case of a
18motorcycle, the department shall issue a decal containing the
19international symbol for access for persons with disabilities
20and the words "disabled veteran" for display on the registration
21plate.

23(c)  Disabled veteran plates.--On the application of any
24veteran having a disability certified by the service unit of the
25armed forces in which the veteran served or by the United States
26Veterans' Administration as service-connected, the department
27shall issue a special registration plate designating the vehicle
28as belonging to a disabled veteran. The registration plate shall
29have a white background, shall have numbers or letters as the
30department may determine and shall have the words "disabled

1veteran" in at least ten-point bold type inscribed at the bottom
2of the plate. Only one special registration plate shall be
3issued to a veteran under this section. It may be used only on a
4passenger car or truck with a registered gross weight of not
5more than [10,000] 14,000 pounds.

6(d)  Prisoner of war plate.--On the application of an ex-
7prisoner of war whose imprisonment while in the service of the
8armed forces of the United States is certified by the
9appropriate branch of the armed forces, the department shall
10issue a special registration plate designating the vehicle as
11belonging to an ex-prisoner of war. The registration plate shall
12contain the letters "POW" and such other numbers or letters as
13the department may determine and shall have the words "prisoner
14of war" in at least ten-point bold type inscribed at the bottom
15of the plate. Only one special registration plate shall be
16issued to an ex-prisoner of war under this subsection. The
17special registration plate may be used only on a passenger car
18or truck with a registered gross weight of not more than
19[10,000] 14,000 pounds.

21§ 1346.  Special plates for recipients of Purple Heart.

22Upon application of any person who is a recipient of the
23Purple Heart, the department shall issue to such person a
24special registration plate designating the vehicle so licensed
25as belonging to a person who is a recipient of the Purple Heart.
26A severely disabled veteran, as described in section 1342(a)
27(relating to veteran plates and placard), who is qualified to
28receive a plate under this section may also elect to receive a
29placard under section 1342(b). The special registration plate
30may be used only on a passenger car or truck with a registered

1gross weight of not more than [10,000] 14,000 pounds.

2§ 1348.  Special plates for Pearl Harbor survivors.

3Upon application of any person who is a survivor of Pearl
4Harbor, accompanied by a fee of $20 which shall be in addition
5to the annual registration fee and by such documentation as the
6department shall require, the department shall issue to such
7person a special registration plate designating the vehicle so
8licensed as belonging to a person who is a survivor of Pearl
9Harbor. The special registration plate may be used only on a
10passenger car or truck with a registered gross weight of not
11more than [10,000] 14,000 pounds.

12§ 1350.  Special plates for veterans of Korean War.

13Upon application of any person who is a veteran of the Korean
14War, accompanied by a fee of $20, which shall be in addition to
15the annual registration fee, and by such documentation as the
16department shall require, the department shall issue to the
17person a special registration plate designating the vehicle so
18licensed as belonging to a person who is a veteran of the Korean
19War. The special registration plate may be used only on a
20passenger car or truck with a registered gross weight of not
21more than [10,000] 14,000 pounds.

22§ 1350.1.  Special plates for recipients of Korean Defense
23Service Medal.

24Upon application of any person who is a recipient of the
25Korean Defense Service Medal, accompanied by a fee of $20 which
26shall be in addition to the annual registration fee and by such
27documentation as the department shall require, the department
28shall issue to the person a special registration plate
29designating the vehicle so licensed as belonging to a person who
30is a recipient of the Korean Defense Service Medal. The

1department shall design and produce the special registration
2plate. The special registration plate may be used only on a
3passenger car or truck with a registered gross weight of not
4more than [10,000] 14,000 pounds.

5§ 1351.  Special plates for veterans of Persian Gulf War.

6Upon application of any person who is a veteran of the
7Persian Gulf War, accompanied by a fee of $20, which shall be in
8addition to the annual registration fee, and by such
9documentation as the department shall require, the department
10shall issue to the person a special registration plate
11designating the vehicle so licensed as belonging to a person who
12is a veteran of the Persian Gulf War. The special registration
13plate may be used only on a passenger car or truck with a
14registered gross weight of not more than [10,000] 14,000 pounds.

15§ 1352.  Wild resource conservation plate.

16The department, in consultation with the Wild Resource
17Conservation Board, shall design a special wild resource
18conservation registration plate. Upon application of any person,
19accompanied by a fee of $35 which shall be in addition to the
20annual registration fee, the department shall issue the plate
21for a passenger car, motor home, trailer or truck with a
22registered gross weight of not more than [10,000] 14,000 pounds.
23The Wild Resource Conservation Fund shall receive $15 of each
24additional fee for this plate.

25§ 1353.  Preserve our heritage registration plate.

26The department, in consultation with the Pennsylvania
27Historical and Museum Commission, shall design a special
28preserve our heritage registration plate. Upon receipt of an
29application, accompanied by a fee of $35 which shall be in
30addition to the annual registration fee, the department shall

1issue the plate for a passenger car, motor home, trailer or
2truck with a registered gross weight of not more than [10,000]
314,000 pounds. The Historical Preservation Fund shall receive
4$15 of each additional fee for this plate.

5§ 1354.  Flagship Niagara commemorative registration plate.

6(a)  Plate.--The department, in consultation with the
7Pennsylvania Historical and Museum Commission, shall design a
8Flagship Niagara commemorative registration plate. Upon
9application of any person, accompanied by a fee of $35 which
10shall be in addition to the annual registration fee, the
11department shall issue the plate for a passenger car, motor
12home, trailer or truck with a registered gross weight of not
13more than [10,000] 14,000 pounds.

15§ 1355.  Zoological plate.

16The department, in consultation with the Pennsylvania
17Zoological Council, shall design a special zoological
18registration plate. Upon application of any person, accompanied
19by a fee of $35 which shall be in addition to the annual
20registration fee, the department shall issue the plate for a
21passenger car, motor home, trailer or truck with a registered
22gross weight of not more than [10,000] 14,000 pounds. The
23Zoological Enhancement Fund shall receive $15 of the fee paid by
24the applicant for the plate.

25§ 1356.  Special plates for recipients of Expeditionary Forces
26Medal.

27Upon application of any person who is a recipient of the
28Expeditionary Forces Medal, accompanied by a fee of $20 which
29shall be in addition to the annual registration fee and by such
30documentation as the department shall require, the department

1shall issue to such person a special registration plate
2designating the vehicle so registered as belonging to a person
3who is a recipient of the Expeditionary Forces Medal. The
4special registration plate may be used only on a passenger car
5or truck with a registered gross weight of not more than
6[10,000] 14,000 pounds.

7§ 1357.  Special plates for World War II veterans.

8Upon application of any person who is a veteran of World War
9II, accompanied by a fee of $20 which shall be in addition to
10the annual registration fee and by such documentation as the
11department shall require, the department shall issue to such
12person a special registration plate carrying the symbol of a
13ruptured duck designating the vehicle so registered as belonging
14to a person who is a veteran of World War II. The special
15registration plate may be used only on a passenger car or truck
16with a registered gross weight of not more than [10,000] 14,000 
17pounds.

18§ 1358.  DARE plate.

19The department, in consultation with the Pennsylvania
20Commission on Crime and Delinquency, shall design a special drug
21abuse resistance education (DARE) registration plate which
22utilizes the DARE logo or slogan in the design. Upon application
23of any person, accompanied by a fee of $35 which shall be in
24addition to the annual registration fee, the department shall
25issue the plate for a passenger car, motor home, trailer or
26truck with a registered gross weight of not more than [10,000]
2714,000 pounds. The Drug Abuse Resistance Education Program shall
28receive $15 of each additional fee for this plate.

29§ 1359.  Special plates for steelworkers.

30(a)  General rule.--Upon application of any person who is a

1steelworker, accompanied by a fee of $20 which shall be in
2addition to the annual registration fee and by such
3documentation as the department shall require, the department
4shall issue to such person a special registration plate
5designating the vehicle so licensed as belonging to a person who
6is a steelworker. The special registration plate may be used
7only on a passenger car or a truck with a registered gross
8weight of not more than [10,000] 14,000 pounds. The plate shall
9bear the likeness of the official emblem of the American Iron
10and Steel Institute.

12§ 1360.  Special plates for veterans of Vietnam Conflict.

13Upon application of any person who is a veteran of the
14Vietnam Conflict as that term is defined for the awarding of the
15Vietnam Service Medal, accompanied by a fee of $20 in addition
16to the annual registration fee and by such documentation as the
17department shall require, the department shall issue to the
18person a special registration plate designating the vehicle so
19licensed as belonging to a person who is a veteran of the
20Vietnam Conflict. The special registration plate may be used
21only on a passenger car or truck with a registered gross weight
22of not more than [10,000] 14,000 pounds.

23§ 1362.  Operation Iraqi Freedom veterans plate.

24Upon application of any person who is a veteran of the
25liberation or occupation of Iraq, accompanied by a fee of $20
26which shall be in addition to the annual registration fee and by
27documentation as the department shall require, the department
28shall issue to the person a special registration plate
29designating the vehicle so licensed as belonging to a person who
30is a veteran of Operation Iraqi Freedom. The special

1registration plate may be used only on a passenger car or truck
2with a registered gross weight of not more than [10,000] 14,000 
3pounds.

4§ 1363.  Operation Enduring Freedom veterans plate.

5Upon application of any person who is a veteran of the
6liberation or occupation of Afghanistan, accompanied by a fee of
7$20 which shall be in addition to the annual registration fee
8and by documentation as the department shall require, the
9department shall issue to the person a special registration
10plate designating the vehicle so licensed as belonging to a
11person who is a veteran of Operation Enduring Freedom. The
12special registration plate may be used only on a passenger car
13or truck with a registered gross weight of not more than
14[10,000] 14,000 pounds.

15Section 2.  Section 1364 of Title 75, amended October 24,
162012 (P.L.   , No.194), is amended to read:

17§ 1364.  Special plates for veterans.

18(a)  Honorably discharged veterans.--Upon application of any
19person who is an honorably discharged veteran of the armed
20forces of the United States or a reserve component of the armed
21forces as defined in 51 Pa.C.S. § 7301 (relating to
22definitions), accompanied by a fee of $20 which shall be in
23addition to the annual registration fee and by such
24documentation as the department shall require, the department
25shall issue to the person a special registration plate
26designating the vehicle as belonging to a person who is a
27veteran of the armed forces of the United States. The special
28registration plate may be used only on a passenger car or truck
29with a registered gross weight of not more than [10,000] 14,000 
30pounds.

1(b)  Honoring our veterans.--Upon application of any person, 
2accompanied by a fee of $35, which shall be in addition to the 
3annual registration fee and by such documentation as the 
4department shall require, the department shall issue to the 
5person a special registration plate designating the vehicle as 
6belonging to a person who is honoring veterans of the armed 
7forces of the United States. The special registration plate may 
8be used only on a passenger car or truck with a registered gross 
9weight of not more than [10,000] 14,000 pounds. The Veterans' 
10Trust Fund shall receive $15 of the fee paid by the applicant 
11for the plate.

12Section 3.  Section 1365(a) of Title 75 is amended to read:

13§ 1365.  Gold Star Family plate.

14(a)  General rule.--Upon application of a family member of a
15person who was killed while serving on active duty in the
16military, accompanied by a fee of $20 which shall be in addition
17to the annual registration fee and by such documentation as the
18department shall require, the department shall issue to the
19family member a special registration plate designating the
20vehicle so licensed as belonging to a family member of a person
21who was killed while serving on active duty in the military. The
22department shall design and produce the special registration
23plate carrying the Service Flag Gold Star rimmed with blue which
24represents sacrifice to the cause of liberty and freedom. The
25words "Gold Star Family" shall be clearly displayed along the
26bottom of the plate. The special registration plate may be used
27only on a passenger car or truck with a registered gross weight
28of not more than [10,000] 14,000 pounds.

30Section 4.  Section 1366.1(a) of Title 75, added October 24,

12012 (P.L.1282, No.158), is amended to read:

2§ 1366.1.  Special plates for United States military airborne
3units.

4(a)  General rule.--Upon application of any person who is a
5veteran of or a member of a United States military airborne
6unit, accompanied by a fee of $20 which shall be in addition to
7the annual registration fee and by such documentation as the
8department shall require, the department shall issue to the
9person a special registration plate designating the vehicle so
10licensed as belonging to a person who is a veteran of or a
11member of a United States military airborne unit. The special
12registration plate may be used only on a passenger car or truck
13with a registered gross weight of not more than [10,000] 14,000 
14pounds. The department shall design and produce the special
15registration plate to display a set of jump wings and glider
16wings.

18Section 5.  This act shall take effect in 60 days.
