AN ACT

 

1Amending Title 25 (Elections) of the Pennsylvania Consolidated
2Statutes, in voter registration, providing for the same day
3registration of a qualified elector.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 1321 of Title 25 of the Pennsylvania
7Consolidated Statutes is amended by adding a paragraph to read:

8§ 1321.  Methods of voter registration.

9An individual qualified to register to vote under section
101301(a) (relating to qualifications to register) may apply to
11register as follows:

13(5)  Under section 1325.1 (relating to same day voter
14registration).

15Section 2.  Title 25 is amended by adding a section to read:

16§ 1325.1.  Same day voter registration.

17(a)  General rule.--A qualified elector may register on

1election day by appearing in person at the polling place for the
2electoral district in which the individual maintains residence
3by completing and submitting a registration application to the
4judge of elections and providing proof of identification and
5residence.

6(b)  Acceptable forms of identification.--In addition to
7providing a completed voter registration form, an applicant must
8provide a valid form of identification, including any of the
9following government issued forms of identification:

10(1)  A valid driver's license or identification card
11issued by the Department of Transportation.

12(2)  A valid identification card issued by another agency
13of the Commonwealth.

14(3)  A valid identification card issued by the United
15States Government.

16(4)  A valid United States passport.

17(5)  A valid United States Armed Forces identification
18card.

19(c)  Procedures for same day registration.--

20(1)  Upon certifying the eligibility of the qualified
21elector, the judge of elections at the polling place shall
22issue a provisional ballot, provided by the county board of
23elections, which is to be completed by the qualified elector
24and sealed in an envelope along with the voter registration
25application.

26(2)  Within ten days of an election, the Department of
27State shall approve or deny a voter registration application
28pursuant to the provisions established in section 1328
29(relating to approval of registration applications).

30(3)  The provisional ballot shall not be counted until

1the Department of State has approved the voter registration
2application.

3(4)  The qualified elector shall be notified in writing
4by the Department of State as to the approval or denial of a
5voter registration application.

6Section 3.  Sections 1326(b) and 1327(c) of Title 25 are
7amended by adding paragraphs to read:

8§ 1326.  Time.

10(b)  Deadlines.--In the administration of voter registration,
11each commission shall ensure that any applicant who is a
12qualified elector is registered to vote in an election when the
13applicant has met any of the following conditions:

15(3.1)  In the case of same day voter registration if the
16valid voter registration application of the applicant is
17accepted in the appropriate electoral district by the
18presiding judge of elections.

22(c)  Distribution.--

24(7)  The secretary shall print and distribute same day
25voter registration applications to all polling places
26throughout this Commonwealth. Along with the distribution of
27such applications, the secretary shall also include
28instructions to inform the applicant of the same day voter
29registration application process, the process for counting
30the applicant's vote and verifying the applicant's

1eligibility.

3Section 4.  This act shall take effect immediately.
