AN ACT
1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in inspection of vehicles, further providing for
3inspection by police or Commonwealth personnel; in
4enforcement, further providing for investigation by police
5officers.
6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:
8Section 1. Sections 4704(a)(2) and 6308(b) of Title 75 of
9the Pennsylvania Consolidated Statutes are amended to read:
10§ 4704. Inspection by police or Commonwealth personnel.
11(a) Authority to inspect.--

13(2) Systematic vehicle inspection programs.--Any
14Pennsylvania State Police officer or qualified Commonwealth
15employee engaged in a systematic vehicle inspection program
16may inspect any vehicle, driver, documents, equipment and
17load to determine whether they meet standards established in
18department regulations. No Commonwealth agency or political
19subdivision shall accept Federal funds to establish a
1systematic vehicle inspection program based on stopping only
2a particular type of vehicle, such as a passenger car, truck
3or motorcycle. Notwithstanding this subsection, Federal
4funding may be accepted if a program stops only commercial
5motor vehicles, as defined in section 1603 (relating to
6definitions).

8§ 6308. Investigation by police officers.

10(b) Authority of police officer.--Whenever a police officer
11is engaged in a systematic program of checking vehicles or
12drivers or has reasonable suspicion that a violation of this
13title is occurring or has occurred, he may stop a vehicle, upon
14request or signal, for the purpose of checking the vehicle's
15registration, proof of financial responsibility, vehicle
16identification number or engine number or the driver's license,
17or to secure such other information as the officer may
18reasonably believe to be necessary to enforce the provisions of
19this title. No Commonwealth agency or political subdivision
20shall accept Federal funds to establish a systematic program of
21checking vehicles or drivers based on stopping only a particular
22type of vehicle, such as a passenger car, truck or motorcycle.
23Notwithstanding this subsection, Federal funding may be accepted
24if a program stops only commercial motor vehicles, as defined in
25section 1603 (relating to definitions).

27Section 2. This act shall take effect in 60 days.
