AN ACT

 

1Authorizing the incurring of indebtedness, with the approval of
2the electors, of up to $150,000,000 for the preservation of
3land for open-space uses and for the mitigation of flood
4hazards.

5The General Assembly of the Commonwealth of Pennsylvania 
6hereby enacts as follows:

7Section 1.  Referendum.

8Pursuant to the provisions of section 7(a)(3) of Article VIII
9of the Constitution of Pennsylvania, the question of incurring
10indebtedness of up to $150,000,000 for the preservation of land
11for open-space uses and for the mitigation of flood hazards
12shall be submitted to electors at the next primary, municipal or
13general election following the effective date of this act.

14Section 2.  Certification.

15The Secretary of the Commonwealth shall certify the question
16to the county boards of elections.

17Section 3.  Form of question.

18The question shall be in the following form:

1Do you favor authorizing the Commonwealth to borrow up to
2$150,000,000 for the preservation of land for open-space
3uses and for the mitigation of flood hazards?

4Section 4.  Conduct of referendum.

5The election shall be conducted in accordance with the act of 
6June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania 
7Election Code, except that:

8(1)  Any requirements for advertising or notice related
9to the question are hereby waived.

10(2)  The requirement for a statement pursuant to section
11201.1 of the Pennsylvania Election Code is hereby waived.

12(3)  Any authority of the Secretary of the Commonwealth
13to determine the form of the question is abrogated.

14Section 5.  Use of bond proceeds.

15Proceeds of borrowing shall be used as determined by the 
16General Assembly by law for the mitigation of flood hazards and 
17to promote the purposes of the act of January 19, 1968 (1967 
18P.L.992, No.442), entitled, as amended, "An act authorizing the 
19Commonwealth of Pennsylvania and the local government units 
20thereof to preserve, acquire or hold land for open space uses."

21Section 6.  Effective date.

22This act shall take effect immediately.
