A RESOLUTION

Directing the Budget and Finance Committee to conduct an

economic impact study of the brewery industry in this

Commonwealth.

Directing the Legislative Budget and Finance Committee to

<--

5

conduct an economic impact study of the brewery industry in

6

this Commonwealth.

7

RESOLVED, That the Senate direct the Budget and Finance

8

Committee to conduct an economic impact study of the brewery

9

industry in this Commonwealth, which study shall:

10

(1)  define and explain the act of April 12, 1951

11

(P.L.90, No.21), known as the Liquor Code, and its

12

administration in layman's terms in order to assist those

13

outside of the brewery industry to understand the issues and

14

challenges faced by the brewery industry under the current

15

regulatory framework;

16

(2)  detail the historical and current conditions of the

17

brewery industry over the last 15 years, including, but not

18

limited to: growth of PA breweries; the global, national and

19

local business climate of breweries; the business climate of

beer wholesalers and retailers; and the consideration of

2

breweries as manufacturers;

3

(3)  focus on the ownership of the breweries, in terms of

4

their status as private, family owned or publicly held;

5

(4)  research brewery industry employment, payroll,

6

capital expenditures and investments that have been made by

7

the brewery industry into the economy of this Commonwealth; 

8

(5)  identify the overall philanthropic contributions

9

made by the brewery industry to charitable and community-

10

based causes and the overall role that breweries in this

11

Commonwealth play in their communities in terms of generating

12

civic pride and economic development;

13

(6)  explain the three-tier system, requirements

14

regarding exclusive distribution agreements and the impact of

15

these factors on the brewery industry;

16

(7)  identify and detail how breweries impact other

17

Pennsylvania industries and Pennsylvania tourism.

18

(8)  identify legislative, administrative and regulatory

19

actions which will ensure the brewery industry's continued

20

growth, thus creating family-sustaining jobs and industry

21

expansion in other sectors including, but not limited to,

22

changes to the Liquor Code and Tax Code;

23

and be it further

24

RESOLVED, That the committee submit its study to the Senate

25

not later than one year from adoption of this resolution.

WHEREAS, Pennsylvania has numerous breweries located in this

Commonwealth; and

28

WHEREAS, The brewery industry in Pennsylvania has contributed

29

to the economic development of this Commonwealth; and

30

WHEREAS, The brewery industry in Pennsylvania contributes to

philanthropic and civic endeavors within communities of this

Commonwealth; and

3

WHEREAS, The act of April 12, 1951 (P.L.90, No.21), known as

4

the Liquor Code, provides the statutory framework for the

5

conduct of the brewery industry; and

6

WHEREAS, The brewery industry in Pennsylvania, the nation and

7

internationally has changed significantly in the last 15 years;

8

and

9

WHEREAS, The continued growth of the brewery industry

10

provides a significant impact to the economic health of this

11

Commonwealth; therefore be it

12

RESOLVED, That the Senate direct the Legislative Budget and

13

Finance Committee to conduct an economic impact study of the

14

brewery industry; and be it further

15

RESOLVED, That the economic impact study include:

16

(1)  An explanation of the three-tier malt and brewed

17

beverage system established in the Liquor Code.

18

(2)  The current economic impact of the brewery industry

19

in this Commonwealth.

20

(3)  The impact of the brewery industry on Pennsylvania

21

tourism.

22

(4)  The impact of the brewery industry on other

23

industries located in this Commonwealth.

24

(5)  The identification of any legislative changes,

25

including, but not limited to, changes to the Liquor Code and

26

the act of March 4, 1971 (P.L.6, No.2), known as the Tax

27

Reform Code of 1971, that will continue to promote the growth 

28

of the brewery industry in this Commonwealth;

and be it further

30

RESOLVED, That the committee submit its study to the Senate
