A RESOLUTION

Adopting a temporary rule of the Senate relating solely to

2

amendments to the General Appropriation Bill and other

3

appropriation bills for the fiscal year beginning July 1,

4

2011, including any amendments offered to or for supplemental

5

appropriations for prior fiscal years.

RESOLVED, That the Senate adopt a temporary rule to read:

7

TEMPORARY RULE

8

I. Budget Amendments on Senate Floor

9

1.  Floor amendments to the General Appropriation Bill or

10

other General Fund or special fund appropriation bills for the

11

fiscal year commencing July 1, 2011, or for any prior fiscal

12

year, shall be in order on second consideration only.

2.  Any amendment offered on the floor of the Senate to the

14

General Appropriation Bill or other General Fund or special fund

15

appropriation bills (which collectively comprise and shall be

16

referred to as the 2011-2012 Budget) that proposes spending from

17

the General Fund or any special fund for the Commonwealth

18

2011-2012 fiscal year, or any prior fiscal year, at a level

19

different from the amount contained in the 2011-2012 Budget as

20

reported from the Appropriations Committee shall not be in order

and may not be considered unless the same amendment, or any

2

"statement of intent" appended thereto, contains sufficient

3

line-item reductions to the 2011-2012 Budget so that the

4

amendment offered does not result in a net increase in the total

5

spending from the General Fund or any special fund contained

6

within such budget. Where a proposed alteration in the General

7

Appropriation Bill is balanced, in whole or in part, by a change

8

in other appropriation bills, the amendment shall have appended

9

thereto a "statement of intent" setting forth the proposed

10

adjustment to the other appropriation bill or bills that will

11

result in there being no net increase in the total spending from

12

the General Fund or any special fund contained within the

13

2011-2012 Budget as reported from the Appropriations Committee.

3.  For the purpose of this temporary rule, the Legislative

15

Reference Bureau, in drafting any amendment to the General

16

Appropriation Bill or any other appropriation bill, shall append

17

the "statement of intent" required for a proposal which involves

18

more than one bill.

19

4.  Any amendment offered on the floor of the Senate

20

proposing to make reductions in the following appropriations

21

shall be out of order:

22

(a)  Debt service.

23

(b)  Transfer to Commonwealth Financing Agency.

24

(c)  School employees' retirement.

25

(d)  School employees' Social Security.

26

(e)  Harristown rentals.

27

(f)  Occupational disease payments.

28

5.  Any amendment offered on the floor of the Senate

29

proposing to make reductions in the following appropriations

30

shall be out of order unless such amendment includes a program

revision not contrary to statutes governing such program:

(a)  Cash assistance grants.

3

(b)  Medical assistance outpatient.

4

(c)  Medical assistance inpatient.

5

(d)  Medical assistance capitation.

6

(e)  Long-term care.

7

(f)  Supplemental Security Income - aged, blind, disabled.

II. Amendments in Appropriations Committee

1.  Any amendment offered in the Appropriations Committee to

10

the General Appropriation Bill that would increase total

11

authorized spending for the Commonwealth 2011-2012 fiscal year

12

or any prior fiscal year above the spending levels contained in

13

the General Appropriation Bill shall not be in order and may not

14

be considered unless the same amendment contains sufficient

15

reductions in line items in the General Appropriation Bill that

16

the amendment does not result in a net increase in the total

17

spending.

2.  Any amendment offered in the Appropriations Committee

19

proposing to make reductions in the following appropriations

20

shall be out of order:

21

(a)  Debt service.

22

III. Suspension

This temporary rule may be temporarily suspended only by a

9

vote of the majority of the members elected to the Senate.

10

IV. Expiration

11

This temporary rule shall expire upon the enactment of a

12

General Appropriation Act for the fiscal year beginning July 1,

13

2011.
