AN ACT

Amending the act of August 26, 1953 (P.L.1476, No.433), entitled

2

"An act to carry out the intent and purpose of Article XV,

3

Section 1 and Article XIV, Section 8 of the Constitution of

4

Pennsylvania, and to supplement the First Class City Home

5

Rule Act, approved April twenty-one, one thousand nine

6

hundred forty-nine (Pamphlet Laws 665), by vesting in the

7

Council of the City of Philadelphia full powers to legislate

8

with respect to the election, appointment, compensation,

9

organization, abolition, merger, consolidation, powers,

10

functions and duties of certain officers, offices, boards and

11

commissions of the City of Philadelphia; providing that such

12

officers may be made appointive or abolished; altering the

13

term of the District Attorney of Philadelphia; and

14

establishing the status of the Sheriff, City Commissioners,

15

Board of Revision of Taxes and Registration Commission, the

16

members of such board and commission, and the subordinates

17

and employes of such officers, board and commission," further

18

providing for powers of the council.

The General Assembly of the Commonwealth of Pennsylvania

20

hereby enacts as follows:

Section 1.  Section 2(c) and (d) of the act of August 26,

22

1953 (P.L.1476, No.433), referred to as the Philadelphia City-

23

County Consolidation Act, added August 13, 1963 (P.L.795,

24

No.395), are amended to read:

(c)  Subject to the provisions of the Philadelphia Home Rule

2

Charter and the First Class City Home Rule Act of April twenty-

3

one, one thousand nine hundred forty-nine (Pamphlet Laws 665),

4

the Council of the City of Philadelphia shall have full powers

5

to legislate with respect to the election, appointment,

6

compensation, organization, abolition, merger, consolidation,

7

powers, functions and duties of the Sheriff, City Commissioners,

8

Registration Commission and Board of Revision of Taxes, or its

9

successor[, with respect to the making of assessments of real

10

and personal property as provided by act of Assembly]. The

11

provisions of Section 1-102 (2) of the Philadelphia Home Rule

12

Charter are hereby validated and the power of Council to act

13

thereunder is hereby confirmed.

(d)  Legislation adopted by the Council of the City of

15

Philadelphia under the authority of subsection (c) of this

16

section shall not be effective until approved by the electorate

17

of the City of Philadelphia in the same manner as amendments to

18

the Home Rule Charter under the First Class City Home Rule Act.

Legislation adopted by the Council of the City of Philadelphia

20

and approved by the electorate of the City of Philadelphia at

21

the primary election held on May 18, 2010, is hereby confirmed,

22

provided that any transfer of authority pursuant to such

23

legislation shall be effective October 1, 2012.

Section 2.  This act shall take effect in 60 days.
