| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," providing for voting following a |
6 | primary or municipal election. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. The act of March 10, 1949 (P.L.30, No.14), known |
10 | as the Public School Code of 1949, is amended by adding a |
11 | section to read: |
12 | Section 328. Voting following a Primary or Municipal |
13 | Election; Penalty.--(a) No school board may vote or take other |
14 | official action, other than votes or actions of a ministerial or |
15 | emergency nature, between October 1 of each odd-numbered year |
16 | and the organizational meeting of the school board required to |
17 | be held in December of such year under section 401. |
18 | (b) Any school directors who vote in violation of subsection |
19 | (a) shall be jointly and severally subject to a surcharge |
20 | payable to the school district equal to ten percent of the cost |

1 | of the matter on which the vote was taken. Whenever it appears |
2 | that a school director may have voted in violation of subsection |
3 | (a), but the matter on which the school director voted was not |
4 | approved by the school board, this subsection shall not apply. |
5 | (c) This section shall not apply to a school district of the |
6 | first class or to a school district in which a special board of |
7 | control has been appointed under section 692. |
8 | Section 2. This act shall take effect in 60 days. |
