AN ACT

Amending the act of June 14, 1961 (P.L.324, No.188), entitled

2

"An act relating to the establishment, operation and

3

maintenance of the State Library and public libraries in the

4

Commonwealth; amending, revising, consolidating and changing

5

the laws relating thereto; imposing duties upon public

6

officers; providing for State and local cooperation and

7

assistance in the establishment and maintenance of libraries;

8

prescribing penalties; and repealing existing laws,"

9

providing for State-aid for 2011-2012.

The General Assembly of the Commonwealth of Pennsylvania

11

hereby enacts as follows:

12

Section 1.  The act of June 14, 1961 (P.L.324, No.188), known

13

as The Library Code, is amended by adding a section to read:

14

Section 303.17.  State-aid for 2011-2012.--Notwithstanding

15

any other provision of law to the contrary, each library shall

16

be eligible for State-aid for fiscal year 2011-2012 which shall

17

consist of the following:

(1)  Funds appropriated for libraries shall be distributed to

19

each library under the following formula:

20

(i)  Divide the sum of the amount of funding that the library

21

received in fiscal year 2010-2011 under section 1722-L(12) of

the act of April 9, 1929 (P.L.364, No.176), known as "The Fiscal

2

Code," by the total State-aid subsidy for fiscal year 2010-2011.

(ii)  Multiply the quotient under subclause (i) by the total

4

State-aid subsidy for 2011-2012.

(2)  Following distribution of funds appropriated for

6

State-aid to libraries, any remaining funds may be distributed

7

at the discretion of the State Librarian.

(3)  If funds appropriated for State-aid to libraries in

9

fiscal year 2011-2012 are less than funds appropriated in fiscal

10

year 2002-2003, the State Librarian may waive standards as

11

prescribed in section 103, relating to hours of operation,

12

continuing professional development, collections, expenditures

13

and other aspects of library operation.

14

(4)  (i)  Each library system receiving State-aid under this

15

section may distribute the local library share of that aid in a

16

manner as determined by the board of directors of the library

17

system.

18

(ii)  Subclause (i) shall not apply to a library system

19

operating in a county of the second class.

20

Section 2.  This act shall take effect in 60 days.
