AN ACT

Amending the act of April 9, 1929 (P.L.177, No.175), entitled

"An act providing for and reorganizing the conduct of the

executive and administrative work of the Commonwealth by the

Executive Department thereof and the administrative

departments, boards, commissions, and officers thereof,

including the boards of trustees of State Normal Schools, or

Teachers Colleges; abolishing, creating, reorganizing or

authorizing the reorganization of certain administrative

departments, boards, and commissions; defining the powers and

duties of the Governor and other executive and administrative

officers, and of the several administrative departments,

boards, commissions, and officers; fixing the salaries of the

Governor, Lieutenant Governor, and certain other executive

and administrative officers; providing for the appointment of

certain administrative officers, and of all deputies and

other assistants and employes in certain departments, boards,

and commissions; and prescribing the manner in which the

number and compensation of the deputies and all other

assistants and employes of certain departments, boards and

commissions shall be determined," further providing for

Pennsylvania State Police.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 205(b) of the act of April 9, 1929

(P.L.177, No.175), known as The Administrative Code of 1929,

amended July 11, 1991 (P.L.73, No.12) and repealed in part

December 13, 2001 (P.L.903, No.100), is amended and the section

is amended by adding subsections to read:

Section 205.  Pennsylvania State Police.--* * *

(b)  [The State Police Force shall consist of such number of

officers and men, and shall be organized in such manner, as the

Commissioner of Pennsylvania State Police, with the approval of

the Governor, shall from time to time determine: Provided,

however, That the] The number of [officers and men] Pennsylvania

State Police shall not exceed in the aggregate at any time

[three thousand nine hundred and forty persons. State policemen,

both officers and men,] four thousand three hundred ten persons,

provided that Pennsylvania State Police members assigned to duty

with the Pennsylvania Turnpike Commission, the Pennsylvania

Gaming Control Board, the Pennsylvania Liquor Control Board, the

Delaware River Joint Toll Bridge Commission or [assigned to

duty] as resident State troopers, shall [not be counted in

determining the total number of officers and men in the State

Police Force] be excluded in determining such number.

(b.1)  On January 1 of each year, if the difference between

the aggregate number of State Police members is less than the

amount authorized in subsection (b) by five per centum or

greater, the Governor shall require the commissioner to

authorize a new cadet class for the next fiscal year to ensure

public safety.

(b.2)  If a cadet class is authorized under subsection (b.1)

it shall be open to no fewer than one hundred fifty individuals.
