| AN ACT |
| |
1 | Establishing the State Military College Legislative Appointment |
2 | Initiative Program. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the State |
7 | Military College Legislative Appointment Initiative Program Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Committee." A State military college selection committee. |
13 | "ECP." The Early Commissioning Program of the United States |
14 | Army. |
15 | "ROTC." Reserve Officers' Training Corps. |
16 | "State military college." A coeducational, postsecondary, |
17 | two-year institution, a part of which is located in a county of |

1 | the third class, whose mission is to educate students in both an |
2 | academic and military environment. |
3 | Section 3. The State Military College Legislative Appointment |
4 | Initiative Program. |
5 | (a) Establishment.--The State Military College Legislative |
6 | Appointment Initiative Program is established within the General |
7 | Assembly. |
8 | (b) State military college selection committee.--Each member |
9 | of the General Assembly may establish a State military college |
10 | selection committee. The committee shall serve the legislative |
11 | district of the member. The State Ethics Commission shall |
12 | develop guidelines to govern the establishment and functions of |
13 | committees to help ensure that the committees and the |
14 | legislative appointments do not create any conflicts of interest |
15 | or otherwise violate 65 Pa.C.S. Ch. 11 (relating to ethics |
16 | standards and financial disclosure) or the act of July 10, 1968 |
17 | (P.L.316, No.154), known as the Legislative Code of Ethics. |
18 | (c) Appointments.--Each member of the General Assembly may |
19 | annually appoint an eligible student who is a resident of the |
20 | member's legislative district for guaranteed initial enrollment |
21 | in a State military college. Appointments must be made at the |
22 | sole recommendation of a State military college selection |
23 | committee. A State military college shall offer initial |
24 | enrollment to any eligible student appointed under this act. |
25 | (d) Educational funding.--Nothing in this act shall be |
26 | construed to establish a scholarship granted or funded by the |
27 | Commonwealth. |
28 | (e) Eligibility.--An individual may be recommended by a |
29 | committee for appointment if the individual meets all of the |
30 | following requirements: |

1 | (1) Graduation from high school or earning a general |
2 | educational development diploma or the equivalent thereof. |
3 | (2) Maintenance of domicile within this Commonwealth |
4 | during the term of the appointment. |
5 | (3) Compliance with any conditions placed upon the |
6 | appointee by a State military college, including all ECP |
7 | admission requirements and requirements deemed necessary to |
8 | successfully matriculate at a State military college. |
9 | (f) Application.--A student shall apply to a committee for a |
10 | recommendation for appointment in a manner prescribed by the |
11 | committee, to include the provision of all information and |
12 | documentation required by the committee. |
13 | (g) Termination.--If a student terminates enrollment in a |
14 | State military college during an academic year or prior to |
15 | completing the two-year program, the State military college |
16 | shall notify the appointing legislator in writing. |
17 | (h) Annual report.--Any member of the General Assembly who |
18 | establishes a committee under subsection (b) shall file an |
19 | annual report with the State Ethics Commission that shall |
20 | include the name of each member of the selection committee for |
21 | that year, the names and addresses of applicants for appointment |
22 | and the name of the applicant who is appointed after final |
23 | selection. |
24 | Section 4. Expiration. |
25 | This act shall expire June 30, 2016, unless reenacted sooner. |
26 | Section 5. Effective date. |
27 | This act shall take effect immediately. |
