| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in offenses against the family, |
3 | further providing for the offense of endangering welfare of |
4 | children. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 4304(b) of Title 18 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 4304. Endangering welfare of children. |

11 | (b) Grading.--[An] |
12 | (1) Except as provided under paragraphs (2) and (3), an |
13 | offense under this section constitutes a misdemeanor of the |
14 | first degree. [However, where] |
15 | (2) If there is a course of conduct of endangering the |
16 | welfare of a child, the offense constitutes a felony of the |
17 | third degree. |
18 | (3) If an offense under this section is the result of |

1 | leaving a child under 13 years of age in a motor vehicle |
2 | without adult supervision, the offense constitutes a felony |
3 | of the third degree. |
4 | Section 2. This act shall take effect in 60 days. |
