| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, in offenses in general, further providing for snow |
3 | or ice dislodged or falling from moving vehicle. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 3720 of Title 75 of the Pennsylvania |
7 | Consolidated Statutes, amended October 19, 2010 (P.L.557, |
8 | No.81), is amended to read: |
9 | § 3720. Snow and ice [dislodged or falling from moving |
10 | vehicle]. |
11 | (a) Duty to remove.-- |
12 | (1) Any driver of a motor vehicle being operated on any |
13 | street or highway of this Commonwealth shall have an |
14 | affirmative duty to make all reasonable efforts to remove all |
15 | accumulated ice or snow from the motor vehicle, including the |
16 | hood, trunk and roof of the motor vehicle. |
17 | (2) Any driver of a motor vehicle who violates this |
18 | subsection may be stopped on a street or highway by a law |

1 | enforcement officer if the law enforcement officer believes |
2 | the accumulated ice or snow may pose a threat to persons or |
3 | property. |
4 | (3) Any person who violates this subsection shall be |
5 | subject to a fine of not less than $25 nor more than $75 for |
6 | each offense regardless of whether any snow or ice is |
7 | dislodged from the vehicle. |
8 | (b) Dislodged or fallen snow or ice.--When snow or ice is |
9 | dislodged or falls from a moving vehicle and strikes another |
10 | vehicle or pedestrian causing death or serious bodily injury, |
11 | the operator of the vehicle from which the snow or ice is |
12 | dislodged or falls shall be subject to a fine of not less than |
13 | $200 nor more than [$1,000] $1,500 for each offense. |
14 | Section 2. This act shall take effect in 60 days. |
