| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in sentencing, further providing for |
3 | sentence for murder and murder of unborn child. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1102(b) of Title 18 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 1102. Sentence for murder, murder of unborn child and murder |
9 | of law enforcement officer. |

11 | (b) Second degree.--[A] |
12 | (1) Except as provided for under paragraph (2), a person |
13 | who has been convicted of murder of the second degree, of |
14 | second degree murder of an unborn child or of second degree |
15 | murder of a law enforcement officer shall be sentenced to a |
16 | term of life imprisonment. |
17 | (2) (i) A person who has been convicted of murder of |
18 | the second degree may be sentenced to a term of life |
19 | imprisonment with the possibility of parole if the person |

1 | was under 18 years of age at the time the offense was |
2 | committed, the person did not directly cause the death of |
3 | the victim, and the death of the victim was not within |
4 | the intent or contemplation of the person. |
5 | (ii) If a person is sentenced under this paragraph |
6 | to a term of life imprisonment with the possibility of |
7 | parole, the sentencing court shall establish a minimum |
8 | term of imprisonment. |
9 | (iii) The person shall be eligible for parole |
10 | consideration only after completing the minimum term of |
11 | imprisonment. |

13 | Section 2. The amendment of 18 Pa.C.S. § 1102(b) shall apply |
14 | to offenses committed after the effective date of this section. |
15 | Section 3. This act shall take effect in 60 days. |
