A CONCURRENT RESOLUTION

Disapproving a Pennsylvania Public Utility Commission regulation

2

on Natural Gas Distribution Companies and the Promotion of

3

Competitive Retail Markets.

WHEREAS, The Pennsylvania Public Utility Commission has

5

proposed, at 39 Pa.B. 3461 (July 11, 2009), a regulation on

6

Natural Gas Distribution Companies and the Promotion of

7

Competitive Retail Markets under the authority of 66 Pa.C.S. §

8

501; and

9

WHEREAS, The House Committee on Consumer Affairs received a

10

report from the Independent Regulatory Review Commission under

11

section 7(c.1) of the act of June 25, 1982 (P.L.633, No.181),

12

known as the Regulatory Review Act, that the Independent

13

Regulatory Review Commission disapproved the final-form

14

regulation; and

15

WHEREAS, Upon the best information and belief of the

16

committee, the Pennsylvania Public Utility Commission desires to

17

implement the final-form regulation without revision or

18

modification; and

WHEREAS, The committee has determined that the final-form

2

regulation should be disapproved by the General Assembly and has

3

notified the Pennsylvania Public Utility Commission of this

4

determination; and

5

WHEREAS, The committee is reporting this resolution under

6

section 7(d) of the Regulatory Review Act for action by the

7

General Assembly within 30 calendar days or ten legislative

8

days, whichever is longer, from the date of reporting this

9

resolution; therefore be it

RESOLVED (the Senate concurring), That the General Assembly

11

disapprove the final-form regulation of the Pennsylvania Public

12

Utility Commission on Natural Gas Distribution Companies and the

13

Promotion of Competitive Retail Markets; and be it further

14

RESOLVED, That notice of the final disposition of this

15

resolution be sent to the Pennsylvania Public Utility Commission

16

and published in the Pennsylvania Bulletin.
