| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for prohibited |
3 | offensive weapons; and providing for knives generally. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 908(c) of Title 18 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 908. Prohibited offensive weapons. |

10 | (c) Definitions.--As used in this section, the following |
11 | words and phrases shall have the meanings given to them in this |
12 | subsection: |
13 | "Firearm." Any weapon which is designed to or may readily be |
14 | converted to expel any projectile by the action of an explosive |
15 | or the frame or receiver of any such weapon. |
16 | "Offensive weapons." Any bomb, grenade, machine gun, sawed- |
17 | off shotgun with a barrel less than 18 inches, firearm specially |
18 | made or specially adapted for concealment or silent discharge, |

1 | any blackjack, sandbag, metal knuckles, [dagger, knife, razor or |
2 | cutting instrument, the blade of which is exposed in an |
3 | automatic way by switch, push-button, spring mechanism, or |
4 | otherwise,] any stun gun, stun baton, taser or other electronic |
5 | or electric weapon or other implement for the infliction of |
6 | serious bodily injury which serves no common lawful purpose. |

8 | Section 2. Chapter 61 of Title 18 is amended by adding a |
9 | subchapter to read: |

14 | 6191. Limitation on regulation of knives and knife making |
15 | components. |
16 | § 6190. Definitions. |
17 | The following words and phrases when used in this subchapter |
18 | shall have the meanings given to them in this section unless the |
19 | context clearly indicates otherwise: |
20 | "Knife." A cutting instrument with a sharpened or pointed |
21 | blade. |
22 | "Municipality." The term shall include a county, city, |
23 | borough, incorporated town or township. |
24 | § 6191. Limitation on regulation of knives and knife making |
25 | components. |
26 | No municipality may regulate the lawful ownership, |
27 | possession, transfer or transportation of knives and knife |
28 | making components when carried or transported for purposes not |
29 | prohibited by the laws of this Commonwealth. |
30 | Section 3. This act shall take effect in 60 days. |
