| AN ACT |
| |
1 | Establishing the Energy Employment Legacy Fund; and providing |
2 | for powers and duties of the Department of Revenue. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited the as Energy |
7 | Employment Legacy Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Department." The Department of Revenue of the Commonwealth. |
13 | "Ethane." A colorless, odorless gaseous alkane, C2H6, which |
14 | occurs as a constituent of natural gas and is used as the raw |
15 | material in the manufacturing of ethylene. |
16 | "Fund." The Energy Employment Legacy Fund established in |
17 | section 3. |

1 | "Natural gas." A fossil fuel consisting of a mixture of |
2 | hydrocarbon gasses, primarily methane, and possibly including |
3 | ethane, propane, butane, pentane, carbon dioxide, oxygen, |
4 | nitrogen and hydrogen sulfide and other gas species. The term |
5 | includes natural gas from oil fields known as associated gas or |
6 | casing head gas, natural gas fields known as nonassociated gas, |
7 | coal beds, shale beds and other formations. The term does not |
8 | include coal bed methane. |
9 | "Number of spud unconventional gas wells." The most recent |
10 | numerical count of spud unconventional gas wells on the |
11 | inventory maintained and provided to the Pennsylvania Public |
12 | Utility Commission by the Department of Environmental Protection |
13 | as of the last day of each month. |
14 | "Producer." A person or its subsidiary, affiliate or holding |
15 | company that holds a permit or other authorization to engage in |
16 | the business of severing natural gas for sale, profit or |
17 | commercial use from an unconventional gas well in this |
18 | Commonwealth. The term does not include a producer that severs |
19 | natural gas from a site used to store natural gas that did not |
20 | originate from the site. |
21 | "Spud." The actual start of drilling of an unconventional |
22 | gas well. |
23 | "Unconventional gas well." A bore hole drilled or being |
24 | drilled for the purpose of or to be used for the production of |
25 | natural gas from an unconventional formation. |
26 | Section 3. Energy Employment Legacy Fund. |
27 | (a) Establishment of fund.--The Energy Employment Legacy |
28 | Fund is established in the State Treasury as a nonlapsing |
29 | restricted interest-bearing account. The fund shall consist of |
30 | the fees collected under subsection (b). Money in the fund and |

1 | the interest it accrues are appropriated to the department for |
2 | the purpose of funding a tax credit for entities purchasing |
3 | ethane for use in manufacturing ethylene at a facility in this |
4 | Commonwealth which has been placed in service on or after the |
5 | effective date of this section. |
6 | (b) Well surcharge.--Each producer shall annually pay a fee |
7 | in an amount calculated by dividing $66,000,000 by the total |
8 | number of spud unconventional gas wells in this Commonwealth and |
9 | multiplying the resulting quotient by the number of spud |
10 | unconventional gas wells of the producer. |
11 | (c) Collection.--The fee shall be collected by the |
12 | department in accordance with procedures established by the |
13 | department. The department shall pay all remitted fees to the |
14 | State Treasurer for deposit into the fund within 30 days of |
15 | receipt, for use as provided in this section. |
16 | (d) Surcharge sunset.--The fee established in subsection (b) |
17 | shall terminate on December 31, 2042. |
18 | Section 4. Effective date. |
19 | This act shall take effect immediately. |
