AN ACT

Establishing the Watershed Disaster Reconstruction Account;

2

providing for transfer from the Surface Mining Conservation

3

and Reclamation Fund; and making appropriations.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Short title.

7

This act shall be known and may be cited as the Watershed

8

Disaster Reconstruction Act of 2012.

Section 2.  Definitions.

10

The following words and phrases when used in this act shall

11

have the meanings given to them in this section unless the

12

context clearly indicates otherwise:

"Account."  The Watershed Disaster Reconstruction Account

14

established in section 3.

Section 3.  Account.

There is hereby established within the General Fund an

17

account to be known as the Watershed Disaster Reconstruction

Section 4.  Transfer.

The sum of $4,400,000 is hereby transferred from the Surface

4

Mining Conservation and Reclamation Fund to the Watershed

5

Disaster Reconstruction Account.

Section 5.  Appropriations.

(a)  Clean streams.--The sum of $3,400,000 is hereby

8

appropriated from the account for allocation by the Governor for

9

payment of the Commonwealth's share necessary to secure Federal

10

funding from the United States Department of Agriculture Natural

11

Resources Conservation Service for stream restoration.

12

(b)  United States Army Corps of Engineers.--The sum of

13

$1,000,000 is hereby appropriated from the account for

14

allocation by the Governor for payment of the Commonwealth's

15

share necessary to secure Federal funding from the United States

16

Army Corps of Engineers to assist with small stream threats to

17

life and property.

Section 6.  Termination.

19

This act shall terminate September 30, 2012, and any money

20

remaining in the account shall be transferred to the Surface

21

Mining Conservation and Reclamation Fund.

Section 7.  Effective date.

23

This act shall take effect immediately.
