| AN ACT |
| |
1 | Amending Title 25 (Elections) of the Pennsylvania Consolidated |
2 | Statutes, providing for restrictions on nomination petitions. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Title 25 of the Pennsylvania Consolidated |
6 | Statutes is amended by adding sections to read: |
7 | § 1404.1. Nomination petition. |
8 | The department and any commission shall not provide any copy |
9 | of any nomination petition that contains the photostatic, |
10 | digitized or electronic signature of any registered elector to |
11 | any individual or entity or business enterprise for any purpose |
12 | apart from those needs which are associated with valid petition |
13 | examinations or challenges. All recipients of nomination |
14 | petition copies shall sign an affidavit which states that the |
15 | affiant will only use nomination petition copies as follows: |
16 | (1) for election-related purposes; |
17 | (2) shall not use, buy or sell nomination petition |
18 | copies for nonelectoral purposes; and |

1 | (3) shall not remove nomination petition copies from any |
2 | official government building where examinations of the same |
3 | are conducted. |
4 | § 1404.2. Enforcement and penalties. |
5 | It shall be a misdemeanor of the second degree if any person, |
6 | entity or other organization is found to be in violation of |
7 | section 1404.1 (relating to nomination petition), with fines not |
8 | to exceed $5,000 for each infraction and imprisonment not to |
9 | exceed two years for all violations cumulatively. Warnings of |
10 | the same shall be printed appropriately on each nomination |
11 | petition form before circulation among nomination electors. |
12 | Section 2. This act shall take effect in 60 days. |
