AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, prohibiting mutilation of female

3

genitalia.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1. Title 18 of the Pennsylvania Consolidated Statutes

7

is amended by adding a section to read:

8

§ 3131.  Female mutilation.

9

(a)  Offense defined.--A person commits female mutilation

10

when:

11

(1)  the person knowingly circumcises, excises or

12

infibulates the whole or any part of the genitalia of a

13

female; or

14

(2)  the person is a parent, guardian or other person who

15

is legally responsible for and charged with the care or

16

custody of a female child 17 years of age or younger, and who

17

allows the circumcision, excision or infibulation of the

whole or any part of the female child's genitalia.

(b)  Grading.--Female mutilation is a misdemeanor of the

3

first degree.

4

(c)  Exception.--A surgical operation is not a violation of

5

this section if such operation is:

6

(1)  necessary to the health of the person on whom it is

7

performed and either is performed by a licensed physician or

8

is performed in the presence of a licensed physician by a

9

person in training to become a licensed physician; or

10

(2)  performed on a person in labor or who has just given

11

birth and is performed for medical reasons connected with

12

that labor or birth by a licensed physician, by a licensed

13

midwife or in the presence of a licensed physician by a

14

person in training to become a licensed physician.

15

Section 2.  This act shall take effect in 60 days.
