AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for a change in the

6

school district fiscal year for third and fourth class school

7

districts.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

Section 1.  Section 671 of act of March 10, 1949 (P.L.30,

11

No.14), known as the Public School Code of 1949, amended

12

December 23, 2003 (P.L.304, No.48), is amended to read:

Section 671.  Fiscal Year.--(a)  In all school districts of

14

the second, third, and fourth class, the fiscal year shall begin

15

on the first day of July in each year: Provided, That the board

16

of school directors of any district of the second, third or

17

fourth class may, by resolution adopted by two-thirds vote of

18

the members thereof at a meeting of the board after not less

19

than ten days' notice of the fact that such resolution would be

presented for action at such meeting, fix the fiscal year of

2

such school district so as to begin on the first day of January

3

in each year instead of on the first day of July as hereinabove

4

provided.

(b)  (1)  For fiscal years beginning after June 30, 2004, a

6

school district of the second, third or fourth class may delay

7

the adoption of its annual budget beyond the last day in June

8

where legislation providing the appropriation for basic

9

education funding to be paid as a reimbursement for the

10

preceding school year is not enacted by June 15.

11

(2)  A school district that delays the adoption of its annual

12

budget under paragraph (1) shall adopt an annual budget no later

13

than fifteen days subsequent to the enactment of legislation

14

providing the appropriation for basic education funding to be

15

paid as a reimbursement for the preceding year.

16

(3)  The provisions of section 687 requiring ten days' public

17

notice prior to final action shall apply in cases when the

18

adoption of a school district's budget is delayed under this

19

subsection.

20

Section 2.  This act shall take effect in 180 days.
