AN ACT

Amending Title 24 (Education) of the Pennsylvania Consolidated

2

Statutes, further providing for Public School Employees'

3

Retirement Board.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 8501(a) of Title 24 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 8501.  Public School Employees' Retirement Board.

(a)  Status and membership.--The board shall be an

10

independent administrative board and shall consist of [15] the

11

following members: the Secretary of Education, ex officio; the

12

State Treasurer, ex officio; two Senators; two members of the

13

House of Representatives; the executive secretary of the

14

Pennsylvania School Boards Association, ex officio; [two] three 

15

to be appointed by the Governor, [at least one of whom shall not

16

be a] none of whom shall be either a current or former school

17

employee or an officer or employee of the State, and who must

18

possess financial, investment or legal experience; three to be

elected by the active professional members of the system from

2

among their number; [one] three to be elected by annuitants from

3

among their number; one to be elected by the active

4

nonprofessional members of the system from among their number;

5

and [one] two to be elected by members of Pennsylvania public

6

school boards from among their number. The appointments made by

7

the Governor shall be confirmed by the Senate and each election

8

shall be conducted in a manner approved by the board. The terms

9

of the appointed and nonlegislative elected members shall be

10

three years. The members from the Senate shall be appointed by

11

the President pro tempore of the Senate and shall consist of one

12

member from the majority and one member from the minority. The

13

members from the House of Representatives shall be appointed by

14

the Speaker of the House of Representatives and shall consist of

15

one member from the majority and one member from the minority.

The legislative members shall serve on the board for the

17

duration of their legislative terms and shall continue to serve

18

until 30 days after the convening of the next regular session of

19

the General Assembly after the expiration of their respective

20

legislative terms or until a successor is appointed for the new

21

term, whichever occurs first. The chairman of the board shall be

22

elected by the board members. Each ex officio member of the

23

board, each elected member of the board and each legislative

24

member of the board may appoint a duly authorized designee to

25

act in his stead. The designee appointed by a member elected by

26

the active professional members of the system must be an active

27

professional member of the system. The designee appointed by a

28

member elected by annuitants must be an annuitant. The designee

29

appointed by a member elected by the active nonprofessional

30

members of the system must be an active nonprofessional member

of the system. The designee appointed by a member elected by

members of the Pennsylvania public school boards must be a

3

member of a Pennsylvania public school board.

Section 2.  Nothing in this act shall preempt or supersede

6

the terms of a collective bargaining agreement in effect on the

7

effective date of this act for the term of that collective

8

bargaining agreement unless otherwise agreed to in writing by

9

the parties to the collective bargaining agreement.

Section 3.  This act shall take effect in 30 days.
