AN ACT

Amending Title 66 (Public Utilities) of the Pennsylvania

2

Consolidated Statutes, providing for the regulation of

3

service voltage.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 66 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 1504.1.  Service voltage.

(a)  Standard voltage.--A public utility shall adopt a

10

standard nominal service voltage for the entire territory served

11

by the public utility and shall file with the commission data on

12

the standard service voltage as part of its officially filed

13

tariff. The suitability and adequacy of the standard nominal

14

service voltage adopted may be determined at any time by the

15

commission.

(b)  Allowable voltage variation for primarily lighting

17

purposes.--For service rendered primarily for lighting purposes,

18

the allowable variation in voltage measured at the service

terminals of the customer may not exceed, for a period longer

2

than one minute in each instance, 5% above or below the standard

3

nominal service voltage and a total variation from minimum to

4

maximum of 8% during normal system operation.

(c)  Allowable voltage variation for primarily power

6

purposes.--For service rendered primarily for power purposes,

7

the allowable variation in voltage measured at the service

8

terminals of the customer may not exceed, for a period longer

9

than one minute in each instance, 10% above or below the

10

standard nominal service voltage during normal system operation.

(d)  Variation in excess of allowable limits.--The following

12

apply:

13

(1)  A public utility may, if approved by the commission,

14

furnish service under conditions of greater voltage

15

variations if there is a filing of the following with the

16

commission:

17

(i)  A copy of existing contracts containing a

18

provision for the supply of service with such greater

19

variations of voltage.

20

(ii)  A copy of contracts made which contemplate the

21

supply of service under conditions of greater voltage

22

variations and which in each case contain a clause

23

stating the probable variations in voltage which will

24

occur in the service rendered under such contract, and

25

further, that such greater variations in voltage will not

26

result in unreasonable discrimination in favor of or

27

against any customer.

(2)  Variations of voltage in excess of those specified

29

under this section caused by the operations of the facilities

30

of the customer in violation of his contract or beyond the

control of the public utility shall not be considered

2

violations of this section.

(3)  Variations of voltage in excess of those specified

4

in the filed tariff rules of the public utility shall be

5

considered a violation of this section if the public utility

6

did not take prudent engineering measures to prevent the

7

variations of voltage. If a public utility violates this

8

section, the commission may impose civil penalties against

9

the public utility in an amount equal to the cost of the

10

actual damages incurred by a customer as a result of the

11

excess voltage, which may be applied to the customer's bill

12

in the form of a credit.

(e)  Records.--A public utility shall keep in continuous

14

operation at least one graphic recording voltmeter on each

15

primary network system or on at least one circuit from each

16

substation supplying more than 1,000 customers. The meters shall

17

be installed either at the substation or near the load center of

18

the area or circuits. The hourly readings of indicating

19

voltmeters recorded at points of supply shall constitute a

20

satisfactory voltage record. A public utility shall also install

21

additional graphic recording voltmeters at the places and for

22

the periods of time as the commission may require.

23

Section 2.  The provisions of 52 Pa. Code § 57.14 (relating

24

to service voltage) are abrogated.

25

Section 3.  This act shall take effect immediately.
