AN ACT

Amending Title 24 (Education) of the Pennsylvania Consolidated

Statutes, further providing for creditable nonschool service.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

Section 1.  Section 8304(b) of Title 24 of the Pennsylvania

6

Consolidated Statutes is amended by adding a paragraph to read:

§ 8304.  Creditable nonschool service.

(b)  Limitations on nonschool service.--Creditable nonschool

10

service credit shall be limited to:

(9)  Previous work experience used by the member to

13

obtain certification as a vocational teacher under a

14

nonbaccalaureate program. The previous work experience used

15

to obtain certification shall be verified by the department

16

upon request of the member and shall be transmitted to the

17

system. For every two years of the previous work experience,

18

a member may buy one year of creditable service, not to

exceed a total of three years. A fraction of a year of the

2

previous work experience that is equal to or greater than

3

one-half shall be considered one year for purposes of this

4

paragraph. The previous work experience does not include time

5

served in an apprenticeship.

Section 2.  Section 8324(e) of Title 24 is amended to read:

§ 8324.  Contributions for purchase of credit for creditable

9

nonschool service and noncreditable school service.

(e)  Creditable work experience.--Contributions on account of

12

Class T-C, Class T-E or Class T-F credit for creditable work

13

experience pursuant to section 8304(b)(6) and (9) shall be the

14

present value of the full actuarial cost of the increase in the

15

projected superannuation annuity caused by the additional

16

service credited on account of the purchase of creditable work

17

experience. The amount paid for the purchase of credit for

18

creditable work experience shall not be payable as a lump sum

19

under section 8345(a)(4)(iii) (relating to member's options).

20

[Any individual eligible to receive an annuity, excluding an

21

annuity received under the Federal Social Security Act (42

22

U.S.C. § 301 et seq.), in another pension system, other than a

23

military pension system, shall not be eligible to purchase this

24

service.]

Section 3.  This act shall take effect in 60 days.
