AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, in snowmobiles and all-terrain vehicles, providing

3

for snowmobile trails.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 75 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 7754.  Snowmobile trails.

(a)  Trail maintenance and grooming.--The department shall

10

give priority to maintaining joint use roads, bridges and trails

11

used as snowmobile trails in a condition that adheres to best

12

management practices and maximizes both financial and natural

13

resources for the benefit of the snowmobiling public.

(b)  Resources extraction.--Snowmobile trails shall not be

15

impacted by mineral or other resource extraction without the

16

department providing alternatives in maintaining the continuity

17

and connectivity of the trail system so affected.

(c)  Grooming and plowing.--Any snow plowing done on roads,

2

bridges or trails which are a part of a designated snowmobile

3

trail or trail system, must adhere to the following:

4

(1)  Joint use roads, bridges and trails shall be

5

maintained so that snowmobiles are not impeded in their use.

6

(2)  When joint use roads, bridges and trails are shared

7

with vehicular traffic, snow removal shall be done in a

8

manner that provides the continued snowmobile use.

9

(3)  Joint use roads, bridges and trails under the

10

control of the department shall be groomed during evening and

11

nighttime hours to maximize safety and surface integrity.

(d)  Specifications.--The department shall require all

13

individuals and organizations who have access to State lands

14

under the department's control for any purpose, or, to gain

15

access for resource recovery or resource extraction use that

16

requires the use of snowplows on State forest and State park

17

roads open to snowmobiling to leave a lane of unplowed snow the

18

width of no less than five feet. Snowplows shall be equipped

19

with adequate shoes to protect the road surface and leave a snow

20

mat of at least three inches.

Section 2.  This act shall take effect in 60 days.
