| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, in accidents and accident reports, further |
3 | providing for the offenses of accidents involving death or |
4 | personal injury and for accidents involving damage to |
5 | attended vehicle or property; and providing for the offense |
6 | of leaving scene of accident. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Sections 3742(a) and 3743(a) of Title 75 of the |
10 | Pennsylvania Consolidated Statutes are amended to read: |
11 | § 3742. Accidents involving death or personal injury. |
12 | (a) General rule.--[The] Except as otherwise provided in |
13 | section 3743.2 (relating to leaving scene of accident), the |
14 | driver of any vehicle involved in an accident resulting in |
15 | injury or death of any person shall immediately stop the vehicle |
16 | at the scene of the accident or as close thereto as possible but |
17 | shall then forthwith return to and in every event shall remain |
18 | at the scene of the accident until he has fulfilled the |
19 | requirements of section 3744 (relating to duty to give |
20 | information and render aid). Every stop shall be made without |

1 | obstructing traffic more than is necessary. |

3 | § 3743. Accidents involving damage to attended vehicle or |
4 | property. |
5 | (a) General rule.--[The] Except as otherwise provided in |
6 | section 3743.2 (relating to leaving scene of accident), the |
7 | driver of any vehicle involved in an accident resulting only in |
8 | damage to a vehicle or other property which is driven or |
9 | attended by any person shall immediately stop the vehicle at the |
10 | scene of the accident or as close thereto as possible but shall |
11 | forthwith return to and in every event shall remain at the scene |
12 | of the accident until he has fulfilled the requirements of |
13 | section 3744 (relating to duty to give information and render |
14 | aid). Every stop shall be made without obstructing traffic more |
15 | than is necessary. |

17 | Section 2. Title 75 is amended by adding a section to read: |
18 | § 3743.2. Leaving scene of accident. |
19 | (a) General rule.--The driver of a vehicle involved in an |
20 | accident subject to the provisions of section 3742 (relating to |
21 | accidents involving death or personal injury) or 3743 (relating |
22 | to accidents involving damage to attended vehicle or property) |
23 | who is in reasonable fear of his safety or the safety of his |
24 | passengers: |
25 | (1) May leave the scene of the accident. |
26 | (2) Shall report the accident by telephone or in person |
27 | to the nearest police department as soon as safely possible |
28 | after the accident. |
29 | (3) Shall submit to the police department the |
30 | information specified in section 3744 (relating to duty to |

1 | give information and render aid). |
2 | (b) Penalty.--Any person violating this section commits a |
3 | summary offense and shall, upon conviction, be sentenced to pay |
4 | a fine of $300 or to imprisonment for not more than 90 days, or |
5 | both. |
6 | Section 3. This act shall take effect in 60 days. |
