| AN ACT |
| |
1 | Authorizing the Department of General Services, with the |
2 | approval of the Governor, to grant and convey to Susquehanna |
3 | Township a pedestrian easement through certain lands situate |
4 | in Susquehanna Township, Dauphin County. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Pedestrian easement in Susquehanna Township, Dauphin |
8 | County. |
9 | (a) Authorization.--The Department of General Services, with |
10 | the approval of the Governor, is hereby authorized on behalf of |
11 | the Commonwealth of Pennsylvania to grant and convey to |
12 | Susquehanna Township a pedestrian easement over and through |
13 | certain lands situate in Susquehanna Township, Dauphin County, |
14 | for $1. |
15 | (b) Description.--The easement to be conveyed under |
16 | subsection (b) consists of approximately 6.44-acres bounded and |
17 | more particularly described as follows: |
18 | ALL THAT CERTAIN strip of land located in Susquehanna |
19 | Township, Dauphin County, being 30 feet wide and extending for a |

1 | length of approximately 5,381 feet (the "Original Pathway"), |
2 | identified as "Proposed 30' Easement" on the "Construction Plan |
3 | for the Capital Area Greenbelt Northern Corridor, Susquehanna |
4 | Township, Dauphin County, Pennsylvania, June 2003" recorded on |
5 | September 12, 2003, at the Recorder of Deeds of Dauphin County |
6 | at Deed Book 255, Page 2802 (the "Plan"), together with an |
7 | additional strip of land extending 35 feet in a northerly or |
8 | westerly direction from the northern or western boundary (as |
9 | applicable) of the Original Pathway between the centerline |
10 | station 51+00 and centerline station 85+00, as such centerline |
11 | stations are depicted on the Plan. |
12 | CONTAINING approximately 6.44-acres. |
13 | (c) Easements.--The conveyance shall be made under and |
14 | subject to all lawful and enforceable easements, servitudes and |
15 | rights of others, including, but not limited to, streets, |
16 | roadways and rights of any telephone, telegraph, water, |
17 | electric, gas or pipeline companies, as well as under and |
18 | subject to any lawful and enforceable estates or tenancies |
19 | vested in third persons appearing of record, for any portion of |
20 | the land or improvements erected thereon. |
21 | (d) Deed.--The deed of easement shall be executed by the |
22 | Secretary of General Services in the name of the Commonwealth of |
23 | Pennsylvania. |
24 | (e) Permanent restriction.--The deed of easement shall |
25 | contain a permanent restriction specifically limiting the use of |
26 | the pedestrian easement by the grantee for the Capital Area |
27 | Greenbelt. If the easement area ceases being utilized for the |
28 | Capital Area Greenbelt, the easement shall immediately |
29 | extinguish and all property rights shall revert to the |
30 | Commonwealth. The restriction shall be in form and substance |

1 | approved by the Department of General Services and shall be |
2 | included in the deed of easement. |
3 | (f) Costs and fees.--Costs and fees incidental to this |
4 | conveyance shall be borne by the grantee. |
5 | (g) Expiration.--In the event that this conveyance is not |
6 | executed within 12 months of the effective date of this section, |
7 | the authority contained in this section shall expire. |
8 | Section 2. This act shall take effect immediately. |
