| A RESOLUTION |
| |
1 | Memorializing the President and the Congress of the United |
2 | States to extend the time frame for assessment of Medicaid |
3 | managed care organizations. |
4 | WHEREAS, The Medicaid Program in Pennsylvania provides health |
5 | care coverage to more than two million senior citizens, persons |
6 | with disabilities, children, pregnant women and low-income |
7 | individuals, with funding provided jointly by the Federal |
8 | Government and the Commonwealth; and |
9 | WHEREAS, Consistent with Federal law, the Commonwealth of |
10 | Pennsylvania and several other states raised a portion of their |
11 | share of Medicaid expenditures through assessments on hospitals, |
12 | nursing homes, Medicaid managed care organizations (MMCOs) and |
13 | other health care providers; and |
14 | WHEREAS, The revenues received through these provider |
15 | assessments generate State funds that are matched with Federal |
16 | dollars and used by the Commonwealth of Pennsylvania to support |
17 | its Medicaid program; and |
18 | WHEREAS, As part of the Deficit Reduction Act of 2005, |

1 | Congress changed Federal law to limit the ability of the |
2 | Commonwealth of Pennsylvania and other states to impose provider |
3 | assessments to support their Medicaid programs so that effective |
4 | October 1, 2009, states may no longer impose existing provider |
5 | assessments solely on MMCOs; and |
6 | WHEREAS, In order to continue their assessments and to use |
7 | the revenues obtained through the assessments to secure Federal |
8 | matching funds, states must extend their MMCO assessments to new |
9 | payors and specifically to all managed care organizations; and |
10 | WHEREAS, This change in Federal law has produced a gap of at |
11 | least $200,000,000 in the Commonwealth of Pennsylvania's Medical |
12 | Assistance budget and threatens Pennsylvania's ability to fund |
13 | programs for seniors, persons with disabilities, children, |
14 | pregnant women and low-income citizens; and |
15 | WHEREAS, With the weakened state of the national economy, |
16 | more and more individuals are in need of the services provided |
17 | by state governments; and |
18 | WHEREAS, The Commonwealth of Pennsylvania, like many other |
19 | states, is undergoing difficult budgetary times due to the |
20 | economy, and the change in Federal law has escalated existing |
21 | budgetary problems brought about by the economy; and |
22 | WHEREAS, Delay in implementing the October 1 date will have |
23 | little impact on the overall Federal budget and will allow the |
24 | national economy to heal with a concomitant healing of state |
25 | budgets; therefore be it |
26 | RESOLVED, That the House of Representatives of the |
27 | Commonwealth of Pennsylvania memorialize the President and the |
28 | Congress of the United States to take all necessary action, and |
29 | if necessary pass legislation that will delay implementation of |
30 | the October 1 deadline of the Deficit Reduction Act of 2005, and |

1 | thereby give Pennsylvania and other states additional time in |
2 | which to enact legislation that will effectively comply with the |
3 | October 1 deadline at a later date; and be it further |
4 | RESOLVED, That copies of this resolution be transmitted to |
5 | the President, the presiding officers of each house of Congress |
6 | and to each member of Congress from Pennsylvania. |
