AN ACT

Amending the act of April 12, 1951 (P.L.90, No.21), entitled, as

2

reenacted, "An act relating to alcoholic liquors, alcohol and

3

malt and brewed beverages; amending, revising, consolidating

4

and changing the laws relating thereto; regulating and

5

restricting the manufacture, purchase, sale, possession,

6

consumption, importation, transportation, furnishing, holding

7

in bond, holding in storage, traffic in and use of alcoholic

8

liquors, alcohol and malt and brewed beverages and the

9

persons engaged or employed therein; defining the powers and

10

duties of the Pennsylvania Liquor Control Board; providing

11

for the establishment and operation of State liquor stores,

12

for the payment of certain license fees to the respective

13

municipalities and townships, for the abatement of certain

14

nuisances and, in certain cases, for search and seizure

15

without warrant; prescribing penalties and forfeitures;

16

providing for local option, and repealing existing laws,"

17

providing for a special club license to be issued to a

18

nonprofit organization selected by the Department of Military

19

and Veterans Affairs for the benefit of present and past

20

members of the Pennsylvania National Guard.

The General Assembly of the Commonwealth of Pennsylvania

22

hereby enacts as follows:

23

Section 1. The act of April 12, 1951 (P.L.90, No.21), known

24

as the Liquor Code, reenacted and amended June 29, 1987 (P.L.32,

25

No.14), is amended by adding a section to read:

Section 408.17.  National Guard Club License.--(a)  Subject

27

to the provisions of this act and regulations promulgated under

this act, the board, upon application, shall issue a special

2

club license to a non-profit organization selected by the

3

Department of Military and Veterans Affairs.

4

(b)  The location of the proposed licensed facility shall be

5

Fort Indiantown Gap.

6

(c)  The purpose of a non-profit organization that will be

7

issued a license under this section is the promotion of military

8

values, and the proposed membership shall be limited to current

9

and former members of the Pennsylvania National Guard.

10

(d)  A maximum of two special club licenses may be issued by

11

the board.

(e)  Any club issued a license under this section shall be

13

eligible for licensing under the act of December 19, 1988

14

(P.L.1262, No.156), known as the "Local Option Small Games of

15

Chance Act," and the club is exempt from the local option

16

requirements of section 14 of that act.

Section 2.  Repeals are as follows:

18

(1)  The General Assembly declares that the repeal under

19

paragraph (2) is necessary to effectuate the addition of

20

section 408.17 of the act.

21

(2)  Section 14 of the act of December 19, 1988

22

(P.L.1262, No.156), known as the Local Option Small Games of

23

Chance Act, is repealed insofar as it is inconsistent with

24

this act.

25

Section 3. This act shall take effect in 60 days.
