AN ACT

Amending the act of July 31, 2003 (P.L.73, No.17), entitled "An

2

act establishing a grant program for volunteer fire companies

3

and volunteer ambulance services; and providing for grant

4

funding," providing for the definitions of "consumer

5

fireworks," "display fireworks" and "municipal fire

6

organization"; establishing a grant program for municipal

7

fire organizations; and imposing a tax.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  Section 102 of the act of July 31, 2003 (P.L.73,

11

No.17), known as the Volunteer Fire Company and Volunteer

12

Ambulance Service Grant Act, is amended by adding definitions to

13

read:

Section 102. Definitions.

15

The following words and phrases when used in this act shall

16

have the meanings given to them in this section unless the

17

context clearly indicates otherwise:

"Consumer fireworks."

20

(1)  Any combustible or explosive composition or any

substance or combination of substances intended to produce

2

visible and audible effects by combustion and which is

3

suitable for use by the public that complies with the

4

construction, performance, composition and labeling

5

requirements promulgated by the Consumer Products Safety

6

Commission under 16 CFR (relating to commercial practices),

7

or any successor regulation, and which complies with the

8

provisions for "consumer fireworks" as defined in the

9

American Pyrotechnics Association (APA) Standard 87-1, or any

10

successor standard.

11

(2)  The term does not include devices as "ground and

12

handheld sparkling devices," "novelties" and "toy caps" in

13

APA Standard 87-1, the sale, possession and use of which

14

shall be permitted at all times throughout this Commonwealth.

15

"Display fireworks."  Large fireworks designed primarily to

16

produce visible or audible effects by combustion, deflagration

17

or detonation. The term includes, but is not limited to, salutes

18

containing more than two grains (130 mg) of explosive materials,

19

aerial shells containing more than 40 grams of pyrotechnic

20

compositions and other display pieces which exceed the limits of

21

explosive materials for classification as consumer fireworks.

22

Display fireworks are classified as fireworks UN0333, UN0334 or

23

UN0335 by the United States Department of Transportation at 49

24

CFR 172.101 (relating to purpose and use of hazardous materials

25

table).

"Municipal fire organization."  A fire department

28

established, operated and funded by a municipality within this

29

Commonwealth that provides fire protection.

Section 2.  The act is amended by adding a chapter to read:

MUNICIPAL FIRE GRANT PROGRAM

4

Section 601.  Establishment of program.

5

The Municipal Fire Grant Program is established and shall be

6

administered by the commissioner. Grants provided under the

7

grant program shall be used to improve and enhance the

8

capabilities of municipal fire organizations to provide

9

firefighting services.

10

Section 602.  Definitions.

11

The following words and phrases when used in this chapter

12

shall have the meanings given to them in this section unless the

13

context clearly indicates otherwise:

14

"Department."  The Department of Revenue of the Commonwealth.

15

"Facility."  A structure or portion thereof intended for the

16

purpose of storage or protection of firefighting apparatus and

17

related equipment and gear. The term does not include meeting

18

halls, social halls, social rooms, lounges or any other facility

19

not directly related to firefighting services.

20

"Fund."  The Municipal Fire Grant Program Fund established in

21

this chapter.

22

"Grant program."  The Municipal Fire Grant Program

23

established in this chapter.

Section 603.  Establishment of fund.

25

There is hereby established in the State Treasury a

26

nonlapsing, restricted, interest-bearing account to be known as

27

the Municipal Fire Grant Program Fund. The fund shall consist of

28

the taxes remitted to the Commonwealth pursuant to section 606.

29

Section 604.  Allocation of appropriated funds.

The commissioner shall provide administrative services and

staff for the purpose of administering the grant program

2

established in this chapter. The cost of providing the

3

administrative services and staff shall be reimbursed to the

4

commissioner from the Municipal Fire Grant Program Fund

5

established in section 603.

6

Section 605.  Guidelines and procedures.

7

The commissioner shall develop guidelines, procedures and all

8

applications necessary to implement the grant program. The

9

commissioner shall submit the guidelines, procedures and

10

applications to the Legislative Reference Bureau for publication

11

in the Pennsylvania Bulletin within 30 days of the effective

12

date of this section.

13

Section 606.  Imposition of fireworks tax.

14

There is hereby imposed upon each separate sale at wholesale

15

or retail of consumer fireworks or display fireworks within this

16

Commonwealth a tax of 6%, which tax shall be collected by the

17

vendor from the purchaser, and shall be paid over to the

18

Commonwealth as provided in this chapter and as provided in the

19

act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform Code

20

of 1971, for deposit into the fund established in section 603.

21

Section 607.  Seasonal tax returns.

22

Notwithstanding any other provisions in this chapter, the

23

department may, by regulation, waive the requirement for the

24

filing of quarterly returns in the case of any vendor whose

25

business is operated only during certain seasons of the year,

26

and may provide for the filing of returns by such persons at

27

times other than those provided by the act of March 4, 1971

28

(P.L.6, No.2), known as the Tax Reform Code of 1971.

Section 608.  Allocation of tax.

30

The tax collected under this chapter shall be exclusively

allocated for expenditure in the grant program established in

2

this chapter.

Section 609.  Award of grants.

4

(a)  Authorization.--The commissioner is hereby authorized to

5

make a grant award to each eligible municipal fire organization

6

for the following:

7

(1)  Construction or renovation of the municipal fire

8

organization's facility and purchase or repair of fixtures

9

and furnishings necessary to maintain or improve the

10

capability of the municipal fire organization to provide fire

11

services.

12

(2)  Repair or purchase of firefighting equipment.

13

(3)  Retirement or reduction of debt associated with

14

paragraph (1) or (2).

15

(4)  Training and certification of members.

16

(b)  Limits.--

17

(1)  Grants shall be not less than $2,500 and not more

18

than $15,000 per municipal fire organization.

19

(2)  Grants may be awarded on a pro rata basis if the

20

total dollar amount of approved applications exceeds the

21

amount of funds appropriated by the General Assembly for this

22

purpose.

23

(c)  Time for filing application and department action.--

24

(1)  The commissioner shall provide written instructions

25

and guidelines for grants under this chapter to the fire

26

chief of each municipal fire organization in this

27

Commonwealth within 60 days of the effective date of this

28

section.

29

(2)  Municipal fire organizations seeking grants under

30

this chapter shall submit completed applications to the

commissioner on or before December 31, 2013. The commissioner

2

shall act to approve or disapprove the application by May 1,

3

2014. Applications that have not been approved or disapproved

4

by the commissioner by May 1, 2014, shall be deemed approved.

(d)  Eligibility.--To receive grant funds under this chapter,

6

a municipal fire organization shall have actively responded to

7

one or more fire emergencies since July 1, 2007, and must sign

8

an agreement to actively participate in the Pennsylvania Fire

9

Information Reporting System.

10

Section 610.  Applicability.

11

This chapter shall apply to tax years beginning after July 1,

12

2011.

13

Section 3.  This act shall take effect in 60 days.
