AN ACT

  

1

Providing for accountability in program performance; and

2

prescribing powers and duties.

3

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the Performance,

7

Accountability and Results Act.

8

Section 2.  Legislative intent and purpose.

9

(a)  Declaration.--The General Assembly finds and declares

10

that accountability in program performance is vital to effective

11

and efficient delivery of governmental services and to maintain

12

public confidence and trust in government. To maximize

13

accountability, a system of strategic planning, performance-

14

based budgeting and performance audits should be implemented to

measure the effectiveness and efficiency of governmental

2

services. It is of paramount public importance that this system

3

encourages full and candid participation throughout State

4

government. This system will generate information necessary for

5

the public to be informed fully and for the General Assembly to

6

make informed and meaningful decisions about the allocation of

7

resources in meeting vital needs.

8

(b)  Purpose.--The purposes of this act are to do all of the

9

following:

10

(1)  Begin to provide a new approach to the planning,

11

budgeting and accountability processes within State

12

government rather than an addition to existing procedures.

13

(2)  Improve the confidence of Pennsylvania citizens in

14

the capability of the government, by systematically holding

15

Commonwealth agencies accountable for achieving program

16

results.

17

(3)  Improve Commonwealth program effectiveness and

18

public accountability by promoting a new focus on results,

19

service quality and customer satisfaction.

20

(4)  Help agency managers improve service delivery, by

21

requiring that they plan for meeting program objectives and

22

by providing them with information about program results and

23

service quality.

24

(5)  Improve legislative decision making by providing

25

more objective information on achieving statutory objectives,

26

and on the relative effectiveness and efficiency of

27

Commonwealth programs and spending.

28

(6)  Improve internal management of the Commonwealth

29

government.

Section 3.  Definitions.

The following words and phrases when used in this act shall

2

have the meanings given to them in this section unless the

3

context clearly indicates otherwise:

4

"Administrative Code of 1929."  The act of April 9, 1929

5

(P.L.177, No.175), known as The Administrative Code of 1929.

6

"Agency."  A Commonwealth agency.

7

"Commonwealth agency."  A department of the executive branch.

8

"Goal."  A statement of result that is intended to be

9

achieved and which may be defined as either:

10

(1)  A general goal, which is a general statement of

11

result that does not include a measurable target level of

12

performance or other objective indicator of success.

13

(2)  A performance measure, which is a specific statement

14

of result that includes a measurable target level of

15

performance or other objective indicator of success.

16

"Independent Fiscal Office."  The office established and

17

provided for in Article V-A of the act of April 9, 1929

18

(P.L.343, No.176), known as The Fiscal Code.

19

"Outcome measure."  An assessment of the results of a program

20

activity compared to its intended purpose, often used as a

21

measure of effectiveness.

22

"Output measure."  The tabulation, calculation or recording

23

of activity or effort which can be expressed in a quantitative

24

or qualitative manner, often used as a measure of the direct

25

result of activity.

26

"Performance indicator."  A particular value or

27

characteristic used to quantitatively and effectively measure

28

program activity and performance. A performance indicator shall

29

be structured as an outcome measure or output measure.

"Program activity."  A specific activity or project as listed

in the annual budget of the Commonwealth.

"Program evaluation."  An assessment, through objective

3

measurement and systemic analysis, of the manner and extent to

4

which programs achieve intended goals.

5

"Secretary."  The Secretary of the Budget of the

6

Commonwealth.

7

"Performance target."  The measurable level of activity,

8

output or outcome. When a performance indicator showing what

9

will be measured is combined with a numerical target showing how

10

much will be achieved, a measurable goal has been defined.

11

"Strategic plan."  A plan developed under section 4.

12

Section 4.  Strategic planning.

13

(a)  Submittal.--In compliance with section 11 and not later

14

than September 30, 2011, the head of each agency shall submit to

15

the secretary and to the General Assembly a strategic plan for

16

program activities, delivering the services and achieving the

17

objectives required under the laws of this Commonwealth and any

18

Federal program in which the Commonwealth participates. The plan

19

shall include all of the following:

20

(1)  The statutory and constitutional objectives of the

21

agency.

22

(2)  A comprehensive mission statement covering the major

23

functions and operations of the agency.

24

(3)  General goals and performance measures, including

25

outcome-related goals and measures, for the major functions

26

and operations of the agency.

27

(4)  A hierarchy of outcome, output and program activity

28

goals and measures whereby the goals at the mid-level and

29

lower levels of the agency shall include the performance

30

indicators that define the outputs that support the agency

outcomes. This hierarchy shall clearly link each goal to the

2

next lower level goals in the hierarchy that support its

3

accomplishment.

(5)  Descriptions of the strategies for how the goals are

5

to be achieved, including all of the following:

6

(i)  The operational processes, skills and

7

technology, and the human, capital, information and other

8

resources required to meet those goals.

9

(ii)  Any new initiative or program activity.

10

(iii)  Any new approaches or methods to operational

11

processes that will be adopted or revised.

12

(iv)  The means of avoiding unnecessary costs and

13

expenditures.

14

(v)  The means of addressing any change in objectives

15

or services since the previous strategic plan.

16

(6)  A description of any program evaluations used in

17

assessing the effectiveness of the programs in achieving

18

their goals, with a schedule for future program evaluations.

19

(b)  Coverage.--The strategic plan shall cover a period of

20

not less than four years forward from the fiscal year in which

21

it is submitted and shall be updated and revised at least every

22

three years. Each agency shall submit a strategic plan that has

23

been updated or revised to the Governor and the General

24

Assembly. The submission shall occur no later than the date by

25

which the Governor submits copies of original agency budget

26

requests, all subsequent revised agency budget requests and a

27

State budget, program and financial plan under section 613 of

28

the Administrative Code of 1929.

29

(c)  Consistency.--The performance-based budget required

30

under section 5 shall be consistent with the agency's strategic

plan. A performance plan may not be submitted for a fiscal year

2

not covered by a current strategic plan under this section.

3

(d)  Governmental functions.--The functions and activities of

4

this section shall be considered to be inherently governmental

5

functions. The drafting of strategic plans under this act shall

6

be performed only by Commonwealth employees, while assistance in

7

guiding the development of the plan may be provided by an

8

outside source.

9

Section 5.  Performance-based budgeting.

10

(a)  Submission.--In compliance with section 11 and beginning

11

with submissions in calendar year 2012 for fiscal year

12

2012-2013, in addition to the budget implementation procedures

13

provided for in Article VI the Administrative Code of 1929, the

14

secretary shall submit to the General Assembly and the

15

Legislative Budget and Finance Committee agency performance

16

budgets as required under this section. The submission of agency

17

performance budgets shall occur no later than the date by which

18

the Governor submits copies of original agency budget requests,

19

all subsequent revised agency budget requests and a State

20

budget, program and financial plan under section 613 of the

21

Administrative Code of 1929. Nothing in this section shall be

22

construed as limiting or reducing the budget implementation

23

procedures set forth under Article VI of the Administrative Code

24

of 1929.

25

(b)  Agency performance budgets.--In carrying out the

26

provisions of this section, the secretary shall require each

27

agency to prepare an agency performance budget covering each

28

program activity set forth in the budget of the agency.

29

(c)  Structure and contents.--Each agency performance budget

30

required to be submitted under this section shall include all of

the following:

(1)  A hierarchy of outcome, output and activity goals

3

and measures whereby the goals at the mid-level and lower

4

levels of the agency define the activities and their outputs

5

that support the intended agency outcomes. The hierarchy

6

shall clearly link each goal to the next lower level goals in

7

the hierarchy that support its accomplishment.

8

(2)  Planned outcomes expressed as either general goals

9

or outcome measures and planned outputs expressed as output

10

measures, which shall include a performance indicator for

11

each general goal and both a performance indicator and a

12

performance target for each outcome or output measure.

13

(3)  The measures of activity, level of effort, output

14

and outcome generated or supported by each program activity.

15

(4)  A per-unit form of each activity, level of effort

16

and the resulting output for each program activity.

17

(5)  The cost of achieving the level of effort quantity

18

target for each program activity which is sufficient to

19

support the planned levels of output and outcome.

20

(6)  The actual outputs and outcomes achieved for each

21

program activity in each agency and their actual costs,

22

showing past performance for the most recent year for which

23

results are available and planned performance for each

24

subsequent year.

25

(7)  A recommended funding level for each program

26

activity within each agency necessary to achieve the planned

27

level of program output.

28

(8)  Additional recommendations regarding the funding,

29

the performance, the feasibility and the sustainability of a

30

program activity that is not meeting the desired outputs or

outcomes.

(9)  Summary descriptions of the strategies for how the

3

goals and output and outcome measures are to be achieved,

4

including all of the following:

5

(i)  The major operational processes to be used, the

6

key skills and technology to be deployed and the human,

7

capital, information and other resources that will be

8

required to meet those goals.

9

(ii)  Any new initiatives that will be undertaken or

10

activities that will be engaged in.

11

(iii)  Any new approaches or methods that will be

12

adopted or revised.

13

(10)  A description of the means to be used to verify and

14

validate the reported results for each measured value.

15

(d)  Governmental functions.--The functions and activities of

16

this section shall be considered to be inherently governmental

17

functions. The drafting of performance budgets under this

18

section shall be performed only by Commonwealth employees, while

19

assistance in guiding the development of the performance budget

20

may be provided by an outside source with expertise in

21

performance-based budgeting.

22

Section 6.  Independent Fiscal Office.

23

(a)  Commonwealth performance budget.--

24

(1)  The Independent Fiscal Office shall receive agency

25

performance budgets and performance reports submitted from

26

the head of each agency under sections 5(a) and 7(a).

27

(2)  The Independent Fiscal Office shall utilize the

28

performance budgets and reports and the information contained

29

therein, in addition to State appropriation information, to

30

craft a Commonwealth performance budget that includes each

agency required to submit agency performance budgets under

2

section 5(a).

3

(3)  The Commonwealth performance budget required under

4

this subsection shall be submitted to the Governor and to the

5

General Assembly by June 1, 2013, and each June 1 thereafter.

6

(4)  In addition to all of the other duties prescribed to

7

the Independent Fiscal Office by law, the Legislative Budget

8

and Finance Committee shall do all of the following:

9

(i)  Establish a performance-based budget division

10

staffed with persons knowledgeable and proficient in

11

performance-based budgeting, budget analysis and budget

12

preparation.

13

(ii)  Gather testimony and other data from officers

14

and employees of each agency as deemed necessary to carry

15

out the provisions of this act.

16

(iii)  Craft a Commonwealth performance-based budget

17

utilizing the agency performance budgets and performance

18

reports submitted under sections 5(a) and 7(a).

19

(iv)  Provide the completed Commonwealth performance

20

budget to the Governor and to the General Assembly by

21

June 1, 2013, and each June 1 thereafter.

22

(b)  Performance-based budgeting.--The Commonwealth

23

performance budget shall include all of the following:

24

(1)  A hierarchy of outcome, output and program activity

25

goals and measures whereby the goals at the mid-level and

26

lower levels of each agency defines the activities and their

27

outputs that support the intended agency outcomes. The

28

hierarchy shall clearly link each goal to the next lower

29

level goals in the hierarchy that support its accomplishment.

(2)  Planned outcomes expressed as either general goals

performance measures, which shall include a performance

3

indicator for each general goal, and both a performance

4

indicator and a performance target for each performance

5

measure.

(3)  The measures of activity, level of effort, output

(4)  A per-unit form of each activity, level of effort

9

and the resulting output for each program activity.

10

(5)  The cost of achieving the level of effort quantity

11

target for each program activity which is sufficient to

12

support the planned levels of output and outcome.

13

(6)  The actual outputs and outcomes achieved for each

14

program activity in each agency and their actual costs,

15

showing past performance for the most recent year for which

16

results are available and planned performance for each

17

subsequent year.

18

(7)  An independent recommended funding level for each

19

program activity within each agency necessary to achieve each

20

performance target.

21

(8)  Additional independent recommendations regarding the

22

funding, performance, feasibility and sustainability of a

23

program activity that is not meeting the desired outputs or

24

outcomes.

25

(c)  Auditor General assistance.--The Independent Fiscal

26

Office may request the Auditor General to conduct a performance

27

audit of any agency program or agency performance report. The

28

Independent Fiscal Office shall notify the Governor and the

29

General Assembly within five days of the request.

30

(d)  Report.--Not before January 1, 2014, and not later than

March 1, 2014, the Independent Fiscal Office shall transmit a

2

report to the Governor and to the General Assembly on the status

3

of the implementation of this act. The report shall do all of

4

the following:

5

(1)  Assess the feasibility and advisability of including

6

agency and Commonwealth performance budgets as part of the

7

annual budget submitted under section 613 of the

8

Administrative Code of 1929.

9

(2)  Describe any difficulties encountered by the

10

agencies or the Independent Fiscal Office in preparing

11

performance budgets.

12

(3)  Recommend whether any additional legislation

13

requiring performance budgets should be proposed and the

14

general provisions of any legislation.

15

(4)  Set forth any recommended changes in the other

16

requirements of this act.

17

(e)  Specification.--  After receipt of the report under

18

subsection (d), the General Assembly may specify that

19

performance budgets be submitted as part of the annual budget

20

submitted by the Governor under section 613 of the

21

Administrative Code of 1929.

22

Section 7.  Annual performance reports.

23

(a)  Submittal.--By March 1, 2014, and each March 1

24

thereafter, the head of each agency shall prepare and submit to

25

the Governor and the Independent Fiscal Office a report on

26

program performance for the previous fiscal year.

27

(b)  Goals and measures.--Each program performance report

28

shall set forth the goals and measures established in the agency

29

performance budget under section (5)(c), along with the actual

30

program performance achieved compared with the goals and

performance measures expressed in the plan for that fiscal year.

2

(c)  Contents.--The report submitted in calendar year 2014

3

shall include planned results for the current fiscal year, the

4

report submitted in calendar year 2014 shall include planned

5

results for the current and actual results for the preceding

6

fiscal year and the report submitted in calendar year 2015 and

7

all subsequent reports shall include actual results for the two

8

preceding fiscal years and planned results for the current

9

fiscal year.

10

(d)  Requirements.--Each report shall do all of the

11

following:

12

(1)  Review the success of achieving the performance

13

measures of the fiscal year.

14

(2)  Evaluate the performance plan for the current fiscal

15

year relative to the performance achieved toward the

16

performance measures in the fiscal year covered by the

17

report.

18

(3)  Explain and describe if a performance measure has

19

not been met. The explanation and description shall include

20

one of the following:

21

(i)  why the measure was not met;

22

(ii)  (A)  the plans and schedules for achieving the

23

established performance measure; or

24

(B)  if the performance measure is impractical or

25

infeasible, reasons why that is the case and what

26

action is recommended.

27

(4)  Include the summary findings of the program

28

evaluations completed during the fiscal year covered by the

29

report.

30

(e)  Financial statement.--An agency head may include all

program performance information required annually under this

2

section in an annual financial statement required under section

3

613 of the Administrative Code of 1929, if the statement is

4

submitted to the General Assembly no later than the date by

5

which the Governor submits copies of original agency budget

6

requests and all subsequent revised agency budget requests and a

7

State budget and program and financial plan under section 613 of

8

the Administrative Code of 1929 for the applicable fiscal year.

9

(f)  Governmental functions.--The functions and activities of

10

this section shall be considered to be inherently governmental

11

functions. The drafting of program performance reports under

12

this section shall be performed only by Commonwealth employees.

13

Section 8.  Auditor General.

14

(a)  Authority.--In addition to the powers and duties

15

prescribed to the Auditor General under Article IV of the act of

16

April 9, 1929 (P.L.343, No.176), known as The Fiscal Code, the

17

Auditor General is vested with the authority to conduct

18

performance audits of any agency required to submit a

19

performance report under section 7.

20

(b)  Request.--The Auditor General shall receive and consider

21

any request from the Independent Fiscal Office under section

22

6(c).

23

(c)  Performance audit.--If the Auditor General declines to

24

conduct a performance audit in response to a request made under

25

section 6(c), the Auditor General shall notify the Governor and

26

the General Assembly of the decision within 30 days of the

27

request.

28

(d)  Report.--The Auditor General shall report the results of

29

any performance audit to the Governor and the General Assembly

30

upon completion of the performance audit.

Section 9.  Legislative oversight and legislation.

2

Nothing in this act shall be construed as limiting the

3

ability of the General Assembly to establish, amend, suspend or

4

annul a goal or performance indicator. Any such action shall

5

have the effect of superseding the goal or performance indicator

6

in the plan submitted under section 5(b).

7

Section 10.  Training.

8

The Office of Administration shall, in consultation with the

9

secretary and the Auditor General, develop a strategic planning

10

and performance measurement training component for its

11

management training program and provide managers with an

12

orientation on the development and use of strategic planning and

13

program performance measurement.

14

Section 11.  Pilot projects.

15

There shall be a pilot project in strategic planning under

16

section 4, and performance-based budgeting under section 5,

17

conducted by at least two agencies for fiscal year 2010-2011 and

18

by at least three agencies for fiscal year 2011-2012.

19

Section 20.  Effective date.

20

This act shall take effect as follows:

21

(1)  Sections 6(a)(2),(3) and (4)(ii), (iii), (iv) and

22

(c) and 8 shall take effect January 1, 2013.

23

(2)  The remainder of this act shall take effect

24

immediately.
