| AN ACT |
| |
1 | Requiring the Department of Corrections to establish a K-9 |
2 | Contraband Cell Phone Detection Program in each of the State |
3 | correctional institutions. |
4 | The General Assembly finds and declares as follows: |
5 | (1) The possession of illegal cell phones by inmates |
6 | poses a serious and imminent danger to the general public by |
7 | allowing prisoners to continue criminal enterprises while |
8 | incarcerated. |
9 | (2) Reports show that illegal activities, including |
10 | crimes against witnesses, have been orchestrated by |
11 | imprisoned individuals with access to contraband cell phones. |
12 | (3) Since initiating its K-9 Cell Phone Detection Unit, |
13 | Maryland has had high rates of success discovering and |
14 | removing illegal cell phones from prisons. |
15 | (4) Other states, including New Jersey and Virginia, |
16 | have initiated K-9 Cell Phone Detection Programs as a way of |
17 | eradicating the possession and use of contraband cell phones |

1 | by inmates in state prisons. |
2 | (5) Since initiating the use of a cell-phone-detecting |
3 | K-9 in its prisons, the City of Philadelphia has had higher |
4 | rates of success than using guards or metal detectors to find |
5 | illegal cell phones. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Purpose. |
9 | The purpose of this act is to establish a K-9 Contraband Cell |
10 | Phone Detection Program in order to eliminate the trafficking of |
11 | cell phones in State correctional institutions and to protect |
12 | the public and to prevent the continuation of criminal |
13 | enterprises during incarceration. |
14 | Section 2. Definitions. |
15 | The following words and phrases when used in this act shall |
16 | have the meanings given to them in this section unless the |
17 | context clearly indicates otherwise: |
18 | "Accounts." The Special Leadership Account (D) of the House |
19 | of Representatives or any other account that is used by the |
20 | House of Representatives for the same purpose. |
21 | "Department." The Department of Corrections of the |
22 | Commonwealth. |
23 | "House." The House of Representatives of the Commonwealth. |
24 | Section 3. Rules and regulations. |
25 | The department shall establish and administer a K-9 |
26 | Contraband Cell Phone Detection Program in each of the State |
27 | correctional institutions. The department shall promulgate rules |
28 | and regulations relating to the creation and administration of |
29 | the program, however, program guidelines shall follow those |
30 | established by the Division of Corrections of the State of |

2 | Section 4. Program funding. |
3 | Funding for the creation, administration and operations of |
4 | the Department of Corrections K-9 Contraband Cell Phone |
5 | Detection Program shall be provided by the Special Leadership |
6 | Account (D) of the House of Representatives or any other account |
7 | that is used by the House of Representatives for the same |
8 | purpose. |
9 | Section 5. Effective date. |
10 | This act shall take effect in 60 days. |
