AN ACT

Providing for the payment of State employees' wages during the

2009 budget impasse.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Short title.

This act shall be known and may be cited as the State

Employees' Wage Payment Act.

Section 2.  Definitions.

The following words and phrases when used in this act shall

have the meanings given to them in this section unless the

context clearly indicates otherwise:

"2009 budget impasse."  The period after June 30, 2009,

during which an appropriation act providing for the payment of

State employees' wages has not been enacted.

"Department."  The Treasury Department of the Commonwealth.

"State employee."  An employee of the Executive, Judicial or

Legislative departments of State government. The term shall not

include any of the following:

(1)  The Governor.

(2)  Any member of the General Assembly.

(3)  Any Cabinet level head.

(4  Any person elected to a Statewide position.

Section 3.  Transfer.

During the 2009 budget impasse, the amount of $510,000,000

shall be transferred from the General Fund to the department for

the purpose under section 4. 

Section 4.  Payment.

Notwithstanding any other provision of law, the department

shall, from the funds transferred under section 3, pay the wages

of State employees for a period of 30 days beginning on July 1,

2009. Any funds transferred under section 3 that have not been

used to pay State employee wages shall be transferred back to

the General Fund upon expiration of the 30-day period.

Section 10.  Effective date.

This act shall take effect immediately.
