AN ACT

Amending the act of June 3, 1937 (P.L.1333, No.320), entitled

2

"An act concerning elections, including general, municipal,

3

special and primary elections, the nomination of candidates,

4

primary and election expenses and election contests; creating

5

and defining membership of county boards of elections;

6

imposing duties upon the Secretary of the Commonwealth,

7

courts, county boards of elections, county commissioners;

8

imposing penalties for violation of the act, and codifying,

9

revising and consolidating the laws relating thereto; and

10

repealing certain acts and parts of acts relating to

11

elections," in primary and election expenses, further

12

providing for registration, for reporting by candidate and

13

political committee and other persons and for late

14

contributions and independent expenditures.

15

The General Assembly of the Commonwealth of Pennsylvania

16

hereby enacts as follows:

17

Section 1.  Section 1624 of the act of June 3, 1937

18

(P.L.1333, No.320), known as the Pennsylvania Election Code,

19

added October 4, 1978 (P.L.893, No.171), is amended to read:

20

Section 1624.  Registration.--

(a)  [Any] Except as provided in subsections (a.1) and (a.2),

2

any political committee which receives contributions in an

3

aggregate amount of two hundred fifty dollars ($250) or more

4

shall file a registration statement, designed by the Secretary

5

of the Commonwealth, with the appropriate supervisor within

6

twenty (20) days after the date on which it receives such

7

amount. Each committee in existence shall have sixty (60) days

8

from the effective date of this amendatory act to comply with

9

the requirements of this section.

(a.1)  A candidate's political committee that is authorized

11

under section 1623 by a candidate for any public office to be

12

filled by the electors of the State at large, a candidate for

13

Senator in the General Assembly or a candidate for

14

Representative in the General Assembly shall file a registration

15

statement with the Secretary of the Commonwealth within twenty

16

(20) days after the date on which the authorization was made by

17

the candidate. A political committee authorized on the effective

18

date of this subsection, which is required to register under

19

this subsection and which has not filed a registration statement

20

under subsection (a), shall have twenty (20) days from the

21

effective date of this subsection to comply with the

22

requirements of this section.

23

(a.2)  A political committee that has expended money for the

24

purpose of influencing the election of a candidate for any

25

public office to be filled by the electors of the State at

26

large, a candidate for Senator in the General Assembly or a

27

candidate for Representative in the General Assembly shall file

28

a registration statement within twenty (20) days after the date

29

on which the expenditure was made.

(b)  Each registration statement shall contain the following

information:

(1)  The name, addresses and phone numbers of the political

3

committee.

4

(2)  The name, address and phone number of the committee's

5

treasurer.

6

(3)  The name, address and phone number of the committee's

7

chairman.

8

(4)  The names, addresses and relationships of other

9

affiliated or connected organizations.

10

(5)  The candidates, if any, and their names and addresses.

11

(6)  The ballot question, if any, which the committee intends

12

to support or oppose.

13

(7)  The banks, safety deposit boxes or other repositories

14

and their addresses used by the committee.

15

(8)  The proposed period of operation of the committee.

16

(c)  The committee shall inform the appropriate supervisor of

17

any changes in the information contained in subsection (b)

18

within thirty (30) days of that change.

19

(d)  [No political committee which receives an aggregate

20

amount of contributions of two hundred fifty dollars ($250) or

21

more may make a contribution to any candidate or political

22

committee unless it has registered with the appropriate

23

supervisor.] A political committee that is not registered in

24

accordance with this section may not make a contribution to any

25

candidate or political committee or any other expenditure.

26

Section 2.  Section 1626 of the act, amended or added October

27

4, 1978 (P.L.893, No.171), July 21, 1979 (P.L.189, No.63), July

28

11, 1980 (P.L.591, No.127), July 11, 1980 (P.L.600, No.128) and

29

July 10, 1981 (P.L.256, No.84), is amended to read:

Section 1626.  Reporting by Candidate and Political

Committees and other Persons.--

2

(a)  [Each] Except as provided in subsection (b.1), each 

3

treasurer of a political committee and each candidate for

4

election to public office shall file with the appropriate

5

supervisor reports of receipts and expenditures on forms,

6

designed by the Secretary of the Commonwealth, if the amount

7

received or expended or liabilities incurred shall exceed the

8

sum of two hundred fifty dollars ($250). Should such an amount

9

not exceed two hundred fifty dollars ($250), then the candidate

10

or the treasurer of the committee shall file a sworn statement

11

to that effect with the appropriate supervisor rather than the

12

report required by this section.

13

(b)  Each report filed under subsection (a) shall include the

14

following information:

15

(1)  The full name, mailing address, occupation and name of

16

employer, if any, or the principal place of business, if self-

17

employed, of each person who has made one or more contributions

18

to or for such committee or candidate within the reporting

19

period in an aggregate amount or value in excess of two hundred

20

fifty dollars ($250), together with the amount and date of such

21

contributions. The accuracy of the information furnished to the

22

candidate or committee shall be the responsibility of the

23

contributor.

24

(2)  The full name and mailing address of each person who has

25

made one or more contributions to or for such committee or

26

candidate within the reporting period in an aggregate amount or

27

value in excess of fifty dollars ($50), together with the amount

28

and date of such contributions. The accuracy of the information

29

furnished by the contributor shall be the responsibility of the

30

contributor.

(3)  The total sum of individual contributions made to or for

2

such committee or candidate during the reporting period and not

3

reported under clauses (1) and (2).

(4)  Each and every expenditure, the date made, the full name

5

and address of the person to whom made and the purpose for which

6

such expenditure was made.

7

(5)  Any unpaid debts and liabilities, with the nature and

8

amount of each, the date incurred and the full name and address

9

of the person owed.

10

(6)  The account shall include any unexpended balance of

11

contributions or other receipts appearing from the last account

12

filed.

13

(b.1)  (1)  For each contribution valued in excess of two

14

hundred fifty dollars ($250), which is received by a candidate

15

for any public office to be filled by the electors of the State

16

at large, a candidate for Senator in the General Assembly, a

17

candidate for Representative in the General Assembly, or a

18

political committee required to register under section 1624(a.1)

19

or (a.2), the candidate or the political committee shall report

20

to the Secretary of the Commonwealth in the manner required by

21

clause (10) the full name, mailing address, occupation and name

22

of employer, if any, or the principal place of business of the

23

person who made the contribution together with the amount and

24

date of the contribution and whether the contribution is

25

monetary or in kind.

26

(2)  For each contribution with a value equal to or less than

27

two hundred fifty dollars ($250), which is received by a

28

candidate for any public office to be filled by the electors of

29

the State at large, a candidate for Senator in the General

30

Assembly, a candidate for Representative in the General Assembly

or a political committee required to register under section

1624 (a.1) or (a.2), the candidate or the political committee

3

shall report to the Secretary of the Commonwealth in the manner

4

required by clause (10) the full name and mailing address of the

5

person who made the contribution together with the amount and

6

date of the contribution and whether the contribution is

7

monetary or in kind.

8

(3)  The accuracy of the information furnished to the

9

candidate or the political committee by the contributor and

10

included in a report filed under clause (1) or (2) shall be the

11

responsibility of the contributor.

12

(4)  For each receipt, other than a contribution reported

13

under clause (1) or (2), which is received by a candidate for

14

any public office to be filled by the electors of the State at

15

large, a candidate for Senator in the General Assembly, a

16

candidate for Representative in the General Assembly, a

17

political committee required to register under section 1624(a.1)

18

or (a.2), the candidate or the political committee shall report

19

to the Secretary of the Commonwealth in the manner required

20

under clause (10) the full name and mailing address of the

21

person from whom the receipt was received together with the

22

amount, the date and a description of the receipt.

23

(5)  For each expenditure made by a candidate for any public

24

office to be filled by the electors of the State at large, a

25

candidate for Senator in the General Assembly, a candidate for

26

Representative in the General Assembly or a political committee

27

that is required to register under section 1624(a.1) or (a.2),

28

the candidate or the political committee shall report to the

29

Secretary of the Commonwealth in the manner required by clause

30

(10) the date made, the full name and address of the person to

whom the expenditure was made and the purpose for which the

2

expenditure was made.

(6)  Each contribution or receipt reported under this

4

subsection shall be reported to the Secretary of the

5

Commonwealth no later than ten (10) business days after the

6

contribution or receipt was received by the candidate or the

7

political committee. Each expenditure reported under this

8

subsection shall be reported to the Secretary of the

9

Commonwealth no later than ten (10) business days after the

10

expenditure was made by the candidate or the political

11

committee.

(7)  During a calendar year in which a candidate for any

13

public office to be filled by the electors of the State at

14

large, a candidate for Senator in the General Assembly, a

15

candidate for Representative in the General Assembly is seeking

16

nomination or election to public office, the candidate or the

17

candidate's political committee shall report to the Secretary of

18

the Commonwealth in the manner required under clause (10) all

19

unpaid debts and obligations as of May 30 and all unpaid debts

20

and obligations as of December 31. During a calendar year in

21

which a candidate for any public office to be filled by the

22

electors of the State at large, a candidate for Senator in the

23

General Assembly, a candidate for Representative in the General

24

Assembly is not seeking nomination or election to public office,

25

the candidate or the candidate's political committee shall

26

report to the Secretary of the Commonwealth in the manner

27

required under clause (10) all unpaid debts and obligations as

28

of December 31. A report filed under this clause shall be filed

29

no later than ten (10) days following the end of the reporting

30

period.

(8)  If a candidate or a political committee required to be

2

registered under section 1624(a.2) contributes to a candidate or

3

political committee required to report under this subsection,

4

the candidate or political committee shall report to the

5

Secretary of the Commonwealth in the manner required by this

6

subsection for all subsequent contributions, receipts and

7

expenditures made by the candidate or political committee.

8

(9)  Each candidate or political committee that is required

9

to report under this subsection shall periodically affirm the

10

accuracy of information contained in the reports filed by the

11

candidate or political committee under clauses (1), (2), (4),

12

(5) and (7) and file a verification. During a calendar year in

13

which a candidate for any public office to be filled by the

14

electors of the State at large, a candidate for Senator in the

15

General Assembly, a candidate for Representative in the General

16

Assembly is seeking nomination or election to public office the

17

candidate or political committee shall affirm the accuracy of

18

the information compiled for the candidate or political

19

committee under clause (11) for the period beginning January 1

20

and ending May 30 and for the period beginning June 1 and ending

21

December 31. During a calendar year in which a candidate for any

22

public office to be filled by the electors of the State at

23

large, a candidate for Senator in the General Assembly, a

24

candidate for Representative in the General Assembly is not

25

seeking nomination or election to public office, the candidate

26

or political committee shall affirm the accuracy of the

27

information compiled for the candidate or political committee

28

under clause (11) for the period beginning January 1 and ending

29

December 31. A candidate or political committee shall file the

30

verification of the compiled information no later than thirty

(30) days following the end of the reporting period. In the case

2

of a candidate, the candidate shall sign and date the

3

verification. In the case of a candidate's political committee,

4

the treasurer of the political committee and the candidate shall

5

sign and date the verification. In the case of any other

6

political committee, the treasurer of the political committee

7

shall sign and date the verification.

8

(10)  Candidates and political committees that are subject to

9

the requirements of this subsection shall file reports of

10

contributions, receipts, expenditures, debts and obligations by

11

electronic means, through the system established under clause

12

(11).

13

(11)  The Secretary of the Commonwealth shall establish an

14

electronic system for the filing, maintenance and compilation of

15

reports of contributions, receipts, expenditures, debts and

16

obligations required to be reported under this subsection. The

17

system shall include a public database which is updated each

18

time a report is filed and which is searchable by date,

19

candidate, political committee, vendor and contributor. The

20

system shall be designed in a manner so that immediately upon

21

reporting the system compiles for each candidate or political

22

committee required to report under this subsection a cumulative

23

report containing the following information:

24

(i)  A listing of all contributions reported under clause

25

(1).

(ii)  A listing of all contributions reported under clause

27

(2).

28

(iii)  A listing of all receipts reported under clause (4).

(iv)  A listing of all expenditures reported under clause

30

(5).

(v)  The unexpended balance of contributions or other

2

receipts brought forward from the previous time period.

3

(vi)  The total of all monetary contributions reported under

4

clauses (1) and (2).

5

(vii)  The total of all receipts reported under clause (4).

6

(viii)  The total of all funds available.

7

(ix)  The total of all expenditures made.

8

(x)  The ending cash balance.

9

(xi)  The total value of in-kind contributions received.

10

(xii)  The total of all unpaid debts and obligations reported

11

under clause (7).

(c)  Vouchers or copies of vouchers for all sums expended

13

amounting to more than twenty-five dollars ($25) shall be

14

retained by the candidate or the committee treasurer and shall

15

be available for public inspection and copying as herein

16

provided. Any person may inspect or copy such vouchers or copies

17

thereof by filing a written request with the appropriate

18

supervisory office which shall notify the candidate or political

19

committee of such request. The candidate or political committee

20

shall have the option of either forwarding such vouchers or copy

21

of the same to the supervisor for such purpose or making the

22

vouchers or copy of the same available to the requesting person.

23

If a candidate or a treasurer of a political committee shall

24

fail to make said vouchers or copies thereof available for

25

inspection and copying when requested by the appropriate

26

supervisory officer, such officer shall direct the candidate or

27

political committee to promptly deliver the vouchers or copies

28

thereof to the supervisory office for purposes of inspection and

29

copying. Costs of copying and costs of delivery by the candidate

30

or treasurer of the requested vouchers or copies thereof shall

be borne by the person requesting same.

(d)  [Pre-election reports by candidates for offices to be

3

voted for by the electors of the State at large and all

4

political committees, which have expended money for the purpose

5

of influencing the election of such candidate, shall be filed

6

not later than the sixth Tuesday before and the second Friday

7

before an election, provided that the initial pre-election

8

report shall be complete as of fifty (50) days prior to the

9

election and the subsequent pre-election report shall be

10

complete as of fifteen (15) days prior to the election.] Pre-

11

election reports by [all other] candidates and political

12

committees that are required to file under subsection (a) and 

13

which have received contributions or made expenditures for the

14

purpose of influencing an election shall be filed not later than

15

the second Friday before an election, provided that such report

16

be complete as of fifteen (15) days prior to the election.

17

(e)  All candidates or political committees, required to file

18

under [this section,] subsection (a) shall also file a post-

19

election report not later than thirty (30) days after an

20

election which shall be complete as of twenty (20) days after

21

the election. In the case of a special election the post-

22

election report shall be complete as of ten (10) days after such

23

special election.

24

(f)  Each report filed under subsection (a), (d) or (e) shall

25

also contain a summary, on a separate page, of the information

26

required by subsection (b).

(g)  Every person, other than a political committee or

28

candidate, who makes independent expenditures expressly

29

advocating the election or defeat of a clearly identified

30

candidate, or question appearing on the ballot, other than by

contribution to a political committee or candidate, in an

2

aggregate amount in excess of one hundred dollars ($100) during

3

a calendar year shall file with the appropriate supervisor, on a

4

form prepared by the Secretary of the Commonwealth, a report

5

which shall include the same information required of a candidate

6

or political committee receiving such a contribution and,

7

additionally, the name of the candidate or question supported or

8

opposed. Reports required by this subsection shall be filed on

9

dates on which reports by political committees making

10

expenditures are required to report under this section.

11

(h)  All reports required to be filed pursuant to this

12

section shall be filed pursuant to section 1630. All reports and

13

statements required by this section shall cover the campaign

14

activity of a candidate only from the last prior report or

15

statement.

16

(i)  An expenditure from a candidate's political committee to

17

another political committee shall be reported as a contribution

18

by the political committee receiving the contribution but need

19

not be reported by the contributing candidate's political

20

committee until the time required by law for that candidate's

21

political committee to report: Provided, however, That if the

22

amount of the contribution exceeds two hundred fifty dollars

23

($250) to a single political committee or one thousand dollars

24

($1,000) in aggregate contributions to more than one political

25

committee for any primary, general or special election, then

26

receipts and expenditures shall be reported by the contributing

27

committee at the same time as required by law for the committee

28

receiving same.

(j)  All "Political Action Committees" shall report to the

30

Secretary of the Commonwealth all expenditures to or made on

behalf of, any State-wide candidate, candidate for the

2

Pennsylvania House of Representatives, or candidate for the

3

State Senate, in the same manner as indicated in this section as

4

a candidate's political committee. This provision shall be in

5

addition to any other filing and reporting provisions of this

6

act which apply to such committees, their treasurers and

7

chairmen.

Section 3.  Section 1628 of the act, amended February 13,

9

1998 (P.L.72, No.18), is amended to read:

Section 1628.  Late Contributions and Independent

11

Expenditures.--Any candidate or political committee, authorized

12

by a candidate and created solely for the purpose of influencing

13

an election on behalf of that candidate, which receives any

14

contribution or pledge of five hundred dollars ($500) or more,

15

and any person making an independent expenditure, as defined by

16

this act, of five hundred dollars ($500) or more after the final

17

pre-election report has been deemed completed shall report such

18

contribution, pledge or expenditure to the appropriate

19

supervisor. Such report shall be sent by the candidate, chairman

20

or treasurer of the political committee within twenty-four (24)

21

hours of receipt of the contribution. It shall be the duty of

22

the supervisor to confirm the substance of such report. The

23

report shall be made by telegram, mailgram, overnight mail [or], 

24

facsimile transmission or other means of electronic

25

transmission, including the system of electronic filing

26

established under section 1626(b.1)(11). Any candidate in his

27

own behalf, or chairman, treasurer or candidate in behalf of the

28

political committee may also comply with this section by

29

appearing personally before such supervisor and reporting such

30

late contributions or pledges.

Section 4.  This act shall take effect as follows:

2

(1)  This section shall take effect immediately.

3

(2)  The addition of section 1626(b.1)(11) of the act

4

shall take effect in 30 days.

5

(3)  The remainder of this act shall take effect January

6

1, 2010.
