| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," further providing for computation of |
6 | distances. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 1366 of the act of March 10, 1949 |
10 | (P.L.30, No.14), known as the Public School Code of 1949, is |
11 | amended to read: |
12 | Section 1366. Computation of Distances.--(a) Where, by the |
13 | terms of this act, or any other act, any distance is specified |
14 | between the residence of any pupil and any public school to be |
15 | attended by him, or any transportation is provided for within or |
16 | beyond any particular distance, in computing such distance no |
17 | allowance shall be made for the distance that the dwelling house |
18 | of the pupil is situated off the public highway, except as set |
19 | forth in subsection (b). All such distances shall be computed by |

1 | the public highway from the nearest point where a private way or |
2 | private road connects the dwelling house of the pupil with the |
3 | highway to the nearest point where said highway touches the |
4 | school grounds of the school to which the pupil has been |
5 | assigned. |
6 | (b) In a planned community as defined in 68 Pa.C.S. § 5103 |
7 | (relating to definitions) that permits the use of its private |
8 | roads by any public school, such roads shall be treated as |
9 | public roads for the purposes of this section. |
10 | Section 2. This act shall take effect in 60 days. |
