AN ACT

Amending the act of November 29, 2004 (P.L.1376, No.178),

2

entitled "An act relating to alternative fuels; establishing

3

the Alternative Fuels Incentive Fund; authorizing grants and

4

rebates to promote the use of alternative fuels; imposing

5

duties on the Department of Environmental Protection;

6

providing for an annual report; allocating funds collected

7

from the utilities gross receipts tax; making an

8

appropriation; abrogating regulations; and making a repeal,"

9

providing for State Government energy efficiency.

The General Assembly of the Commonwealth of Pennsylvania

11

hereby enacts as follows:

12

Section 1.  The act of November 29, 2004 (P.L.1376, No.178),

13

known as the Alternative Fuels Incentive Act, is amended by

14

adding a section to read:

15

Section 3.2.  State government energy efficiency.

16

(a)  Definitions.--The following words and phrases when used

17

in this section shall have the meanings given to them in this

18

subsection unless the context clearly indicates otherwise:

19

"Department."  The Department of General Services of the

20

Commonwealth.

"Governmental unit."  A department or agency under the

2

jurisdiction of the Governor of the Commonwealth.

3

"Secretary."  The Secretary of General Services of the

4

Commonwealth.

5

"State building."  A structure occupied by an executive

6

agency, an independent agency, a State-affiliated entity or a

7

State-related institution as defined in 62 Pa.C.S. § 103 

8

(relating to definitions) or by the United Judicial System and

9

its officers.

(b)  Overall energy reduction target.--On or before December

11

31, 2013, the Commonwealth shall reduce its overall use of

12

petroleum-based heating and transportation-based fuels by 15%

13

from the usage levels existing on June 30, 2006.

14

(c)  Reducing energy use in State buildings.--The department

15

shall establish an energy efficiency savings program for all

16

State buildings managed by the department or another department

17

or agency within the executive branch. The program shall include

18

reduction of the Commonwealth's petroleum-based energy use in

19

all Commonwealth-owned facilities in accordance with the

20

requirements set forth in subsection (b). The department shall

21

reach this goal by December 31, 2013, when compared to energy

22

use and energy purchases for the fiscal year ending June 30,

23

2006.

(d)  Energy efficiency and State motor vehicle fleet.--In

25

managing the Commonwealth's fleet of motor vehicles, the

26

department shall:

27

(1)  Ensure compliance with the requirements of the

28

Energy Policy Act of 1992 (Public Law 102-486, 42 U.S.C. §

29

13201 et seq.) by acquiring alternative fuel vehicles capable

30

of operating on nonpetroleum fuels or on blended fuels with

lower petroleum content.

(2)  Increase the number of hybrid or other alternative

3

fueled vehicles within the Commonwealth vehicle fleet and

4

reduce the Commonwealth's petroleum-based transportation

5

energy use in accordance with the requirements set forth in

6

subsection (b). The department shall ensure that the purchase

7

and deployment of the hybrid or other alternative fueled

8

vehicles are cost-effective and capable of meeting the

9

Commonwealth's transportation needs.

(3)  Increase the use and procurement of alternative fuel

11

and bio-based lubricants used within the Commonwealth vehicle

12

fleet in accordance with the requirements set forth in

13

subsection (b). The department shall conduct an analysis of

14

the vehicle fuel and the amount of lubricants used by all

15

fleet vehicles and develop a schedule for increasing the

16

amount of alternative fuel and bio-based lubricants over this

17

period.

(4)  (i)  Increase the use and procurement of diesel fuel

19

with the highest percentage of biodiesel content in the

20

blend that is available. The target shall be to increase

21

the Commonwealth's utilization of biodiesel as part of

22

its overall effort to meet the requirements set forth in

23

subsection (b).

(ii)  The biodiesel used in the blend shall be from a

25

qualified Pennsylvania-based biodiesel producer.

26

(iii)  The requirements of subparagraph (ii) shall

27

not apply:

28

(A)  to aviation fuel;

29

(B)  where prohibited by law; or

30

(C)  to any vehicle owned or operated by an

agency under the Governor's jurisdiction and of an

2

independent agency, State-affiliated entity or State-

3

related institution for which mechanical failure due

4

to the use of biodiesel will void the manufacturer's

5

warranty for that vehicle.

6

Section 2.  This act shall take effect in 60 days.
