SENATE BILL

                                     AN ACT

     1  Providing for conditions for the funding of cargo airport
     2     project funding.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Cargo Airport
     7  Funding Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Community and Economic
    13  Development of the Commonwealth.
    14     "Integrated carrier."  A carrier that provides door-to-door
    15  air cargo transportation using its own or contracted airplanes
    16  and motor trucks.
    17     "Project."  The construction and operation of a cargo airport
    18  within this Commonwealth.

     1  Section 3.  Commonwealth funding.
     2     No Commonwealth funds shall be authorized, expended or
     3  released for any project in this Commonwealth until the
     4  following have occurred:
     5         (1)  The project has been approved by the Bureau of
     6     Aviation within the Department of Transportation.
     7         (2)  The department certifies that the developer of the
     8     project has secured private equity investments in the project
     9     equal to 50% of the total estimated project cost or
    10     $250,000,000, whichever is greater.
    11         (3)  The department certifies that the developer has
    12     obtained a written commitment from one or more integrated
    13     carriers to serve as an anchor tenant of the airport.
    14         (4)  The developer executes an enforceable letter of
    15     commitment with one or more integrated carriers and the
    16     department guaranteeing the level of activity to be conducted
    17     at the cargo airport. The department shall establish the
    18     minimum levels of activity to be conducted at the cargo
    19     airport.
    20         (5)  The developer obtains all State and local permits
    21     required to complete the project.
    22         (6)  The developer executes an agreement with each
    23     county, municipality and school district where the project is
    24     located to provide financial assistance to offset increased
    25     costs realized by the county, municipality or school district
    26     due to the project.
    27  Section 20.  Effective date.
    28     This act shall take effect immediately.
