           We, the undersigned, Committee of Conference on the part of
        the Senate and House of Representatives for the purpose of
        considering Senate Bill No. 1389, entitled:
        "An act to provide from the General Fund for the expenses of the
        Executive, Legislative and Judicial Departments of the
        Commonwealth, the public debt and the public schools for the
        fiscal year July 1, 2008, to June 30, 2009, * * * TO PROVIDE FOR  <--
        THE ADDITIONAL APPROPRIATION OF FEDERAL AND STATE FUNDS FROM THE
        GENERAL FUND FOR THE EXECUTIVE, LEGISLATIVE AND JUDICIAL
        DEPARTMENTS OF THE COMMONWEALTH FOR THE FISCAL YEAR JULY 1,
        2007, TO JUNE 30, 2008, AND FOR THE PAYMENT OF BILLS INCURRED
        AND REMAINING UNPAID AT THE CLOSE OF THE FISCAL YEAR ENDING JUNE

                                     AN ACT

     1  To provide from the General Fund for the expenses of the
     2     Executive, Legislative and Judicial Departments of the
     3     Commonwealth, the public debt and the public schools for the
     4     fiscal year July 1, 2008, to June 30, 2009, for certain
     5     institutions and organizations, and for the payment of bills
     6     incurred and remaining unpaid at the close of the fiscal year
     7     ending June 30, 2008; to provide appropriations from the
     8     State Lottery Fund, the Energy Conservation and Assistance
     9     Fund, the Hazardous Material Response Fund, The State Stores
    10     Fund, the Milk Marketing Fund, the Home Investment Trust
    11     Fund, the Emergency Medical Services Operating Fund, the
    12     Tuition Payment Fund, the Banking Department Fund, the
    13     Firearm Records Check Fund, the Ben Franklin Technology
    14     Development Authority Fund and the Tobacco Settlement Fund to
    15     the Executive Department; to provide appropriations from the
    16     Judicial Computer System Augmentation Account to the Judicial
    17     Department for the fiscal year July 1, 2008, to June 30,
    18     2009; to provide appropriations from the Motor License Fund
    19     for the fiscal year July 1, 2008, to June 30, 2009, for the
    20     proper operation of the several departments of the
    21     Commonwealth and the Pennsylvania State Police authorized to
    22     spend Motor License Fund moneys; to provide for the
    23     appropriation of Federal funds to the Executive Department of
    24     the Commonwealth and for the payment of bills remaining
    25     unpaid at the close of the fiscal year ending June 30, 2008;
    26     to provide for the additional appropriation of Federal and
    27     State funds from the General Fund for the Executive,
    28     Legislative and Judicial Departments of the Commonwealth for
    29     the fiscal year July 1, 2007, to June 30, 2008, and for the
    30     payment of bills incurred and remaining unpaid at the close
    31     of the fiscal year ending June 30, 2007.

     1  Section 2002.  Effective date.
     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4                               PART I
     5                         GENERAL PROVISIONS
     6     Section 101.  Short title.--This act shall be known and may
     7  be cited as the General Appropriation Act of 2008.
     8     Section 102.  Definitions.--The following words and phrases
     9  when used in this act shall have the meanings given to them in
    10  this section unless the context clearly indicates otherwise:
    11     "Employees."  Includes all directors, superintendents, bureau
    12  or division chiefs, assistant directors, assistant
    13  superintendents, assistant chiefs, experts, scientists,
    14  engineers, surveyors, draftsmen, accountants, secretaries,
    15  auditors, inspectors, examiners, analysts, statisticians,
    16  marshals, clerks, stenographers, bookkeepers, messengers and
    17  other assistants in any department, board or commission.
    18     "Expenses" and "maintenance."  Includes all printing, binding
    19  and stationery, food and forage, materials and supplies,
    20  traveling expenses, training, motor vehicle supplies and
    21  repairs, freight, express and cartage, postage, telephones and
    22  telegraph rentals and toll charges, newspaper advertising and
    23  notices, public advertising by or through any medium, fuel,
    24  light, heat, power and water, minor construction and renovation,
    25  repairs or reconstruction of equipment, buildings and
    26  facilities, rent of real estate and equipment, premiums on
    27  workers' compensation, insurance premiums on policies of
    28  liability insurance, insurance premiums on medical payment
    29  insurance and surety bonds for volunteer workers, premiums on
    30  employee group life insurance and employee and retired employee

     1  group hospital and medical insurance, payment of Commonwealth
     2  share of Social Security taxes and unemployment compensation
     3  costs for State employees, the purchase of replacement or
     4  additional equipment and machinery and all other incidental
     5  costs and expenses, including payment to the Department of
     6  General Services of mileage and other charges for the use of
     7  automobiles and rental payments for permanently assigned
     8  automobiles and of expenses or costs of services incurred
     9  through the Purchasing Fund. The term "expenses" also shall
    10  include the medical costs for the treatment of inmates of State
    11  institutions when the inmate must be transferred to an outside
    12  hospital, provided, that in no case shall the State institution
    13  pay more for patient care than that provided under the State
    14  medical assistance program.
    15     Section 103.  Abbreviations.--The following abbreviations
    16  when used in this act shall have the meanings given to them in
    17  this section unless the context clearly indicates otherwise:
    18     "ARC."  Appalachian Regional Commission.
    19     "BG."  Block grant.
    20     "CCDFBG."  Child Care and Development Fund Block Grant.
    21     "CSBG."  Community Services Block Grant.
    22     "DCSI."  Drug Control and Systems Improvement Formula Grant
    23  Program.
    24     "DFSC."  Drug Free Schools and Communities Act.
    25     "DOE."  Department of Energy.
    26     "EEOC."  Equal Employment Opportunity Commission.
    27     "EPA."  Environmental Protection Agency.

    20  be necessary, are hereby specifically appropriated from the
    21  General Fund to the several hereinafter named agencies of the
    22  Executive, Legislative and Judicial Departments of the
    23  Commonwealth for the payment of salaries, wages or other
    24  compensation and travel expenses of the duly elected or
    25  appointed officers and employees of the Commonwealth, for the
    26  payment of fees for contractual services rendered, for the
    27  purchase or rental of goods and services, printing, public
    28  advertising by or through any medium, equipment, land and
    29  buildings and for payment of any other expenses, as provided by
    30  law or by this act, necessary for the proper conduct of the

     1  duties, functions and activities and for the purposes
     2  hereinafter set forth for the fiscal year beginning July 1,
     3  2008, and for the payment of bills incurred and remaining unpaid
     4  at the close of the fiscal year ending June 30, 2008.
     5     (b)  State Lottery Fund.--The following sums set forth in
     6  this act, or as much thereof as may be necessary, are hereby
     7  specifically appropriated from the State Lottery Fund to the
     8  several hereinafter named agencies of the Executive Department
     9  of the Commonwealth for the payment of salaries, wages or other
    10  compensation and travel expenses of the duly appointed officers
    11  and employees of the Commonwealth, for the payment of fees for
    12  contractual services rendered, for the purchase or rental of
    13  goods and services and for payment of any other expenses, as
    14  provided by law or by this act, necessary for the proper conduct
    15  of the duties, functions and activities and for the purposes
    16  hereinafter set forth for the fiscal year beginning July 1,
    17  2008, and for the payment of bills incurred and remaining unpaid
    18  at the close of the fiscal year ending June 30, 2008.
    19     (c)  Energy Conservation and Assistance Fund.--The following
    20  sums set forth in this act, or as much thereof as may be
    21  necessary, are hereby specifically appropriated from the Energy
    22  Conservation and Assistance Fund to the several hereinafter
    23  named agencies of the Executive Department of the Commonwealth
    24  for the payment of fees for contractual services rendered, for
    25  the purchase or rental of goods and services and for the payment
    26  of any other expenses, as provided by law or by this act,
    27  necessary for the proper conduct of the duties, functions and
    28  activities and for the purposes hereinafter set forth for the
    29  fiscal year beginning July 1, 2008, and for the payment of bills
    30  incurred and remaining unpaid at the close of the fiscal year

     1  ending June 30, 2008.
     2     (d)  Judicial Computer System Augmentation Account.--The
     3  following sums set forth in this act, or as much thereof as may
     4  be necessary, are hereby specifically appropriated from the
     5  restricted receipt account established within the General Fund,
     6  known as the Judicial Computer System Augmentation Account, to
     7  the Judicial Department of the Commonwealth for the payment of
     8  salaries, wages or other compensation and travel expenses, for
     9  the payment of fees for contractual services rendered, for the
    10  purchase or rental of goods and services and for the payment of
    11  any other expenses, as provided by law or by this act, necessary
    12  for the proper conduct of the duties, functions and activities
    13  and for the purposes hereinafter set forth for the fiscal year
    14  beginning July 1, 2008, and for the payment of bills incurred
    15  and remaining unpaid at the close of the fiscal year ending June
    16  30, 2008.
    17     (e)  Emergency Medical Services Operating Fund.--The
    18  following sums set forth in this act, or as much thereof as may
    19  be necessary, are hereby specifically appropriated from the
    20  Emergency Medical Services Operating Fund to the several
    21  hereinafter named agencies of the Executive Department of the
    22  Commonwealth for the payment of fees for contractual services
    23  rendered, for the purchase or rental of goods and services and
    24  for the payment of any other expenses, as provided by law or by
    25  this act, necessary for the proper conduct of the duties,
    26  functions and activities and for the purposes hereinafter set
    27  forth for the fiscal year beginning July 1, 2008, and for the
    28  payment of bills incurred and remaining unpaid at the close of
    29  the fiscal year ending June 30, 2008.
    30     (f)  The State Stores Fund.--The following sums set forth in

     1  this act, or as much thereof as may be necessary, are hereby
     2  specifically appropriated from The State Stores Fund to the
     3  hereinafter named agency of the Executive Department of the
     4  Commonwealth for the payment of salaries, wages or other
     5  compensation and travel expenses of the duly appointed officers
     6  and employees of the Commonwealth, for the payment of fees for
     7  contractual services rendered, for the purchase or rental of
     8  goods and services and for the payment of any other expenses, as
     9  provided by law or by this act, necessary for the proper conduct
    10  of the duties, functions and activities and for the purposes
    11  hereinafter set forth for the fiscal year beginning July 1,
    12  2008, and for the payment of bills incurred and remaining unpaid
    13  at the close of the fiscal year ending June 30, 2008.
    14     (g)  Motor License Fund.--The following sums, or as much
    15  thereof as may be necessary, are hereby appropriated from the
    16  Motor License Fund to the hereinafter named agencies of the
    17  Executive Department for the payment of salaries, wages and
    18  other compensation and travel expenses of the duly elected or
    19  appointed officers and employees of the Commonwealth, for
    20  contractual services and other expenses necessary for the proper
    21  conduct of the duties, functions and activities for the purposes
    22  hereinafter set forth for the fiscal year beginning July 1,
    23  2008, and for the payment of bills incurred and remaining unpaid
    24  at the close of the fiscal year ending June 30, 2008.
    25     (h)  Aviation Restricted Revenue Account.--The following
    26  sums, or as much thereof as may be necessary, are hereby
    27  appropriated from the Aviation Restricted Revenue Account in the
    28  Motor License Fund to the hereinafter named agencies of the
    29  Executive Department for the purposes set forth herein for the
    30  fiscal year beginning July 1, 2008, and for the payment of bills

     1  incurred and remaining unpaid at the close of the fiscal year
     2  ending June 30, 2008.
     3     (i)  Hazardous Material Response Fund.--The following sums
     4  set forth in this act, or as much thereof as may be necessary,
     5  are hereby specifically appropriated from the Hazardous Material
     6  Response Fund to the several hereinafter named agencies of the
     7  Executive Department of the Commonwealth for the payment of fees
     8  for contractual services rendered, for the purchase or rental of
     9  goods and services and for the payment of any other expenses, as
    10  provided by law or by this act, necessary for the proper conduct
    11  of the duties, functions and activities and for the purposes

    16  Communities Development Block Grant (SCDBG) is to assist small
    17  cities and communities that have a high concentration of
    18  impoverished citizens and substandard housing to expand their
    19  low-income and moderate-income housing opportunities and to meet
    20  community development needs.
    21     (c)  Community Services Block Grant.--The Community Services
    22  Block Grant (CSBG) is to provide a range of services and
    23  activities having a measurable and potentially major impact on
    24  the causes of poverty in the community or those areas of the
    25  community where poverty is a particularly acute problem. In
    26  addition, new focus may be placed on the unemployed, both old
    27  and new. Local agencies may lower their eligibility requirements
    28  for recipients to three months to allow greater flexibility to
    29  assure proper consideration of each recipient.
    30     (d)  Preventive Health and Health Services Block Grant.--The

     1  Preventive Health and Health Services Block Grant (PHHSBG) is
     2  for the provision of preventive health and other health services
     3  related to emergency medical systems, health initiative grants,
     4  comprehensive public health, hypertension, fluoridation, health
     5  education, risk reduction, home health, rape crisis and domestic
     6  violence services.
     7     (e)  Maternal and Child Health Services Block Grant.--The
     8  Maternal and Child Health Services Block Grant (MCHSBG) is to
     9  enable states to maintain and strengthen their leadership in
    10  planning, promoting, coordinating and evaluating health care for
    11  pregnant women, mothers, infants and children, and children with
    12  special health care needs and in providing health services for
    13  mothers and children who do not have access to adequate health
    14  care.
    15     (f)  Low-Income Home Energy Assistance Block Grant.--The Low-
    16  Income Home Energy Assistance Block Grant (LIHEABG) is to help
    17  lessen the impact of the high cost of energy on low-income
    18  families and individuals, including energy efficiency grants for
    19  low-income dwellings. No less than 15% of the LIHEABG funds
    20  received shall be used for weatherization. LIHEABG funds
    21  received pursuant to a Presidential release of contingency funds
    22  shall be exempt from the 15% requirement.
    23     (g)  Social Services Block Grant.--The Social Services Block
    24  Grant (SSBG) is for the provision of social services to eligible
    25  persons.
    26     (h)  Mental Health Services Block Grant.--The Mental Health
    27  Services Block Grant (MHSBG) provides funds for the provision of
    28  services to adults with serious mental illness or children with
    29  serious emotional disturbance.
    30     (i)  Substance Abuse Block Grant.--The Substance Abuse Block

     6               MISCELLANEOUS PROVISIONS FOR 2007-2008
     7     Section 1751.  Prior laws unaffected.--This act is not
     8  intended to be inconsistent with or to repeal any provision of
     9  any act enacted at this or any prior session of the General
    10  Assembly regulating the purchase of supplies, the ordering of
    11  printing and binding, the purchase, maintenance and use of
    12  automobiles, the method of making payments from the State
    13  Treasury for any purpose or the functioning of any
    14  administrative department, board or commission.
    15     Section 1752.  Compliance with other law before funds
    16  available.--No appropriation made by this part to any
    17  department, board, commission or agency of the Executive
    18  Department shall be available unless and until the department,
    19  board, commission or agency has complied with sections 615 and
    20  616 of the act of April 9, 1929 (P.L.177, No.175), known as The
    21  Administrative Code of 1929.
    22     Section 1753.  Contracts prerequisite to encumbering or
    23  committing funds.--Funds for the purchase of supplies, materials
    24  and equipment shall not be deemed to be committed or encumbered
    25  until contracts covering the purchase have been entered into
    26  with the vendors.
    27     Section 1754.  Minority business set-asides.--(a)  Each
    28  department or other instrumentality of the Commonwealth listed
    29  in Subpart B authorized to contract for buildings, highways,
    30  commodities, equipment, supplies or services shall report to the

     1  General Assembly all information pertinent to anticipated
     2  procurement needs at the beginning of each fiscal year and each
     3  fiscal quarter thereafter.
     4     (b)  As used in this section, the term "minority business"
     5  means a minority business enterprise as defined in the act of
     6  July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
     7  Minority Business Development Authority Act.
     8     Section 1755.  Appropriation of funds from miscellaneous
     9  sources.--(a)  In addition to the amounts appropriated by this
    10  part, moneys received in payment for food and household supplies
    11  furnished to employees and other persons, except inmates, by an
    12  institution, and moneys received from the proceeds from the sale
    13  of any products of the soil, meats, livestock, timber or other
    14  materials sold by the department shall be paid into the General
    15  Fund and are hereby appropriated out of the General Fund to the
    16  several respective institutions for the operation and
    17  maintenance of the institutions.
    18     (b)  In addition to the amounts appropriated by this part,
    19  all moneys received from any other source, except the Federal
    20  Government, as contributions for the programs provided herein or
    21  as payment for services or materials furnished by one
    22  institution to another, except those collections designated as
    23  revenues, shall be paid into the General Fund and are hereby
    24  appropriated out of the General Fund for the purposes of the
    25  respective appropriations.
    26     (c)  In addition to any funds specifically appropriated by
    27  this part, all moneys received by a department or agency of the
    28  Commonwealth from any other sources, except the Federal
    29  Government, as contributions or supplements to the department or
    30  agency for a program or administration of an act included in

     1  this part shall be paid into the General Fund and credited to
     2  the appropriation for that program or administration of the act.
     3     Section 1756.  Lapsing of unused funds.--(a)  Except as
     4  otherwise provided by law or by this section, that part of all
     5  appropriations in Part XVII unexpended, uncommitted or
     6  unencumbered as of June 30, 2008, shall automatically lapse as
     7  of that date.
     8     (b)  The appropriation in Subpart C to the Legislative
     9  Department for legislative printing and expenses shall be a
    10  continuing appropriation.
    11     (c)  The appropriation in Subpart D to the Judicial
    12  Department for the courts of common pleas and community courts -
    13  magisterial district justices shall be continuing
    14  appropriations.
    15     (d)  Notwithstanding the provisions of section 1906(a) of the
    16  act of July 17, 2007 (P.L.499, No.8A), known as the General
    17  Appropriation Act of 2007, the appropriations in section 281 for
    18  the salaries and expenses of the Supreme Court and the Court
    19  Administrator, section 282 for the salaries and expenses of the
    20  Superior Court and section 283 for the salaries and expenses of
    21  the Commonwealth Court shall be continuing appropriations.
    22     Section 1757.  Construction with prior appropriation acts.--
    23  Any appropriation in Subparts B, C, D and E of this part which
    24  is the same or similar to any appropriation in the act of July
    25  17, 2007 (P.L.499, No.8A), known as the General Appropriation
    26  Act of 2007, shall replace that appropriation.
    27     Section 1758.  Deduction of expended appropriations under
    28  prior law.--Any money which has been appropriated and expended
    29  under the act of July 17, 2007 (P.L.499, No.8A), known as the
    30  General Appropriation Act of 2007, shall be deducted from the

     1  corresponding appropriation in this part.
     2                             PART XVIII
     3                SPECIAL PROVISIONS FOR FEDERAL FUNDS
     4                           FOR 2008-2009
     5     Section 1801.  General Fund repository for Federal funds.--
     6  All moneys received from the Federal Government as contributions
     7  or supplements to the departments or agencies of the
     8  Commonwealth or the programs herein provided shall be paid into
     9  the General Fund.
    10     Section 1802.  Limitation on encumbering or spending Federal
    11  funds.--Federal funds shall be encumbered or spent only to the
    12  extent that such funds are estimated as being available during
    13  the fiscal year of the Commonwealth.
    14     Section 1803.  Appropriation of prior unspent Federal
    15  funds.--(a)  Any Federal money which has been previously
    16  appropriated by the General Assembly and authorized or allocated
    17  by the Federal Government but remains unspent from prior fiscal
    18  years and will not be renewed for fiscal year 2008-2009 is
    19  hereby appropriated.
    20     (b)  The Federal appropriations to the Department of Public
    21  Welfare include any prior earnings that may be received during
    22  fiscal year 2008-2009. In addition to the amounts specifically
    23  appropriated herein to the Department of Public Welfare, all
    24  moneys appropriated from the Federal Government during any
    25  previous fiscal year which are expected to be received as
    26  reimbursements may be carried forward until June 30, 2009, to
    27  the extent that obligations are carried forward. In addition,
    28  any reimbursements actually received to support such obligations
    29  may also be carried forward.
    30     Section 1804.  Subgrants between Federal fund

     1  appropriations.--Subgrants may be made between appropriations
     2  without further approval of the General Assembly. The Secretary
     3  of the Budget shall submit a list of subgrants to the chairman
     4  and minority chairman of the Appropriations Committee of the
     5  Senate and the chairman and minority chairman of the
     6  Appropriations Committee of the House of Representatives
     7  quarterly. No subgrant to a State agency, however, may be made
     8  from a restricted receipt account without a specific
     9  appropriation by the General Assembly.
    10     Section 1805.  Utilization of emergency Federal funds.--(a)
    11  Federal funds available for costs and damages resulting from
    12  natural disasters or civil disobedience may be added to an
    13  appropriation contained in this act or to funds appropriated or
    14  may be used for the purposes prescribed by the Federal
    15  Government.
    16     (b)  In addition to the moneys appropriated by this act, all
    17  moneys received from the Federal Government for the purpose of
    18  disaster assistance or relief, or other moneys received as a
    19  direct result of terrorist acts, moneys for homeland security
    20  and defense and moneys for avian flu/pandemic preparedness shall
    21  be paid into the General Fund and are hereby appropriated out of
    22  the General Fund to the departments, boards, commissions or
    23  agencies designated by the Governor.
    24     (c)  In the event of any emergency situation in which the
    25  General Assembly cannot act in sufficient time, the Governor is
    26  authorized through executive authorization to provide up to
    27  $10,000,000 in Federal funds to alleviate the emergency
    28  situation. For the purposes of this section, "emergency" is
    29  defined as any situation in which there is a chance of or which
    30  may result in substantial human suffering.

     1     Section 1806.  Transfer of funds from TANFBG to CCDFBG and
     2  SSBG.--In accordance with Federal law which permits the transfer
     3  of funds from the TANFBG to the CCDFBG and SSBG, the Department
     4  of Public Welfare, upon approval of the Secretary of the Budget,
     5  may make such transfers of funds provided that any such transfer
     6  will not result in a deficit in any appropriation from which
     7  funds are transferred. The Secretary of the Budget shall provide
     8  ten days prior notification of any such transfers to the
     9  chairman and the minority chairman of the Appropriations
    10  Committee of the Senate and the chairman and minority chairman
    11  of the Appropriations Committee of the House of Representatives.
    12                              PART XIX
    13               MISCELLANEOUS PROVISIONS FOR 2008-2009
    14     Section 1901.  Prior laws unaffected.--Except as provided in
    15  section 253, this act is not intended to be inconsistent with or
    16  to repeal any provision of any act enacted at this or any prior
    17  session of the General Assembly regulating the purchase of
    18  supplies, the ordering of printing and binding, the purchase,
    19  maintenance and use of automobiles, the method of making
    20  payments from the State Treasury for any purpose or the
    21  functioning of any administrative department, board or
    22  commission.
    23     Section 1902.  Compliance with other law before funds
    24  available.--No appropriation made by this act to any department,
    25  board, commission or agency of the Executive Department shall be
    26  available unless and until the department, board, commission or
    27  agency has complied with sections 615 and 616 of the act of
    28  April 9, 1929 (P.L.177, No.175), known as The Administrative

    30     Section 1903.  Contracts prerequisite to encumbering or

     1  committing funds.--Funds available to agencies, boards,
     2  departments, commissions or other governmental entities under
     3  this act for the procurement of supplies, services or
     4  construction shall not be available for payment of or to be
     5  committed to or encumbered for payment of any such procurement
     6  unless and until the agency, board, department or other
     7  governmental entity has complied with all of the requirements
     8  applicable to the procurement that are set out in 62 Pa.C.S.
     9  (relating to procurement) and in the policies, procedures and
    10  regulations instituted in accordance with that code.
    11     Section 1904.  Minority business set-asides.--(a)  Each
    12  department or other instrumentality of the Commonwealth listed
    13  in Subpart A of Part II authorized to contract for buildings,

    18  otherwise provided by law or by this section, that part of all
    19  appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X,
    20  XI, XII, XIII, XIV, XV and XVI unexpended, uncommitted or
    21  unencumbered as of June 30, 2009, shall automatically lapse as
    22  of that date.
    23     (b)  The appropriation in Part II to the Department of
    24  Agriculture for transition to organic farming shall be a
    25  continuing appropriation.
    26     (c)  The appropriation in Part II to the Department of
    27  Community and Economic Development for family savings accounts
    28  shall be a continuing appropriation.
    29     (d)  The appropriation in Part II to the Pennsylvania
    30  Emergency Management Agency for April 2005 Disaster - Public

     1  Assistance shall be a continuing appropriation.
     2     (e)  The appropriation in Part II to the Pennsylvania
     3  Emergency Management Agency for June 2006 Flood Disaster -
     4  Public Assistance shall be a continuing appropriation.
     5     (f)  The appropriation in Part II to the Pennsylvania
     6  Emergency Management Agency for November 2006 Storm Disaster -
     7  Public Assistance shall be a continuing appropriation.
     8     (g)  The appropriation in Part II to the Department of
     9  General Services for the printing of the Pennsylvania Manual
    10  shall be a continuing appropriation.
    11     (h)  The appropriations in Part II to the Legislative
    12  Department shall be continuing appropriations.
    13     (i)  The appropriations in Part II to the Supreme Court for
    14  the unified judicial security programs shall be a continuing
    15  appropriation.
    16     (j)  The appropriation in Part II for county court
    17  reimbursements for the gun courts shall be a continuing
    18  appropriation until June 30, 2010.
    19     Section 1907.  Appellate courts appropriation contingency.--
    20  The funds appropriated in Part II to the Supreme, Superior and
    21  Commonwealth Courts for justice and judge expenses are
    22  contingent upon a vouchered expense account plan being continued
    23  by the Supreme Court.
    24     Section 1908.  Transfer of excess funds.--The Governor may
    25  transfer any excess money in those funds receiving proceeds of
    26  Commonwealth of Pennsylvania general obligation bonds in excess
    27  of the amount necessary for the purposes for which the bonds
    28  were issued to the appropriate sinking fund for payment of debt
    29  service due on outstanding bonds. If such excess funds, together
    30  with any available balance, exceed the amount of debt service

     1  remaining to be paid, the funds shall be transferred to the
     2  General Fund or to the appropriate special fund responsible for
     3  such debt service.
     4     Section 1909.  Transfer from Banking Fund.--The sum of
     5  $15,000,000 is transferred from the Banking Fund to the General
     6  Fund.
     7     Section 1910.  Transfer from Recycling Fund.--The sum of
     8  $15,000,000 is transferred from the Recycling Fund to the
     9  General Fund.
    10     Section 1911.  Transfer from Manufacturing Fund.--The sum of
    11  $5,000,000 is transferred from the Manufacturing Fund to the
    12  Department of Corrections to augment the appropriations for the
    13  State correctional institutions.
    14     Section 1912.  Transfer from PHEAA Account.--The following
    15  amounts shall be transferred from the Pennsylvania Higher
    16  Education Assistance Agency to the General Fund:
    17         (1)  The sum of $6,300,000 from the Medical Education
    18     Loan Assistance Program under Article XXII-A of the act of
    19     March 10, 1949 (P.L.30, No.14), known as the Public School
    20     Code of 1949.
    21         (2)  The sum of $8,500,000 from the New Economy
    22     Technology Scholarship Program under the act of June 23, 1999
    23     (P.L.159, No.22), known as the New Economy Technology
    24     Scholarship Act.
    25     Section 1913.  Contingent lapse of certain appropriation.--
    26  Any part of the appropriation for volunteer emergency responder
    27  assistance under section 225 which is unexpended, uncommitted or
    28  unencumbered as of the date of enactment of a tax credit program
    29  for volunteer emergency responders shall lapse as of that date.

     1                           EFFECTIVE DATE
     2     Section 2001.  Retroactivity.--This act shall be retroactive
     3  as follows:
     4         (1)  The provisions of Part XVII of this act shall be
     5     retroactive to July 1, 2007.
     6         (2)  Except as provided in paragraph (1), if the date of
     7     enactment is after July 1, 2008, the remainder of this act
     8     shall be retroactive to July 1, 2008.
     9     Section 2002.  Effective date.--This act shall take effect
    10  immediately.
