           FONTANA, FUMO, GORDNER, GREENLEAF, KITCHEN, MADIGAN, MELLOW,
           MUSTO, O'PAKE, ORIE, PILEGGI, PIPPY, PUNT, RAFFERTY, REGOLA,
           SCARNATI, STACK, TARTAGLIONE, TOMLINSON, WASHINGTON, WAUGH

        SENATOR McILHINNEY, GAME AND FISHERIES, AS AMENDED,
           JUNE 24, 2008

                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing for resident license and fee
     3     exemptions for deployed Pennsylvania National Guard members.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2706(f) AND (G) of Title 34 of the         <--
     7  Pennsylvania Consolidated Statutes is ARE amended to read:        <--
     8  § 2706.  Resident license and fee exemptions.
     9     * * *
    10     (f)  Pennsylvania National Guard hunting licenses.--
    11         (1)  Pennsylvania National Guard hunting licenses shall
    12     be issued by the commission or county treasurer to any person
    13     otherwise eligible for a resident hunting license in this
    14     Commonwealth who provides documentation that within the
    15     previous 24 months the person was deployed overseas as a
    16     member of the Pennsylvania Army National Guard or Air

     1     National Guard on active Federal service for a period of
     2     [180] 120 60 consecutive days or more or was released early    <--
     3     from such service because of an injury or disease incurred in
     4     the line of duty. Only one Pennsylvania National Guard
     5     hunting license under this subsection may be issued for each
     6     qualifying deployment of a person applying for the license.
     7         (2)  The commission may promulgate regulations to
     8     implement this subsection.

    10     (G)  RESERVE COMPONENT OF ARMED FORCES HUNTING LICENSES.--     <--
    11         (1)  RESERVE COMPONENT OF THE ARMED FORCES HUNTING
    12     LICENSES SHALL BE ISSUED BY THE COMMISSION OR COUNTY
    13     TREASURER TO ANY PERSON OTHERWISE ELIGIBLE FOR A RESIDENT
    14     HUNTING LICENSE IN THIS COMMONWEALTH WHO PROVIDES
    15     DOCUMENTATION THAT WITHIN THE PREVIOUS 24 MONTHS THE PERSON
    16     WAS DEPLOYED OVERSEAS AS A MEMBER OF THE RESERVE COMPONENT OF
    17     THE ARMED FORCES PURSUANT TO 51 PA.C.S. § 7301 (RELATING TO
    18     DEFINITIONS) FOR A PERIOD OF [180] 60 CONSECUTIVE DAYS OR
    19     MORE OR WAS RELEASED EARLY FROM SERVICE BECAUSE OF AN INJURY
    20     OR DISEASE INCURRED IN THE LINE OF DUTY. ONLY ONE HUNTING
    21     LICENSE UNDER THIS SUBSECTION MAY BE ISSUED FOR EACH
    22     QUALIFYING DEPLOYMENT OF A PERSON APPLYING FOR THE LICENSE.
    23         (2)  THE COMMISSION MAY PROMULGATE REGULATIONS TO
    24     IMPLEMENT THIS SUBSECTION.
    25     Section 2.  This act shall take effect immediately.
