                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     impersonating a public servant.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4912 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4912.  Impersonating a public servant.
     9     (a)  Offense defined.--A person commits a misdemeanor of the
    10  second degree if he falsely pretends to hold a position in the
    11  public service or to be a veteran with intent to induce another
    12  to submit to such pretended official authority or to act upon
    13  such pretended status as a veteran or otherwise to act in
    14  reliance upon that pretense to his prejudice.
    15     (b)  Definitions.--As used in this section, the following
    16  words and phrases shall have the meanings given to them in this
    17  subsection:
    18     "Position in the public service" and "public servant."  The

     1  terms include, but are not limited to, active membership in the
     2  armed forces of the United States.
     3     "Veteran."  A person who served or after the effective date
     4  of this subsection serves in the armed forces of the United
     5  States, or in any women's organization officially connected
     6  therewith, during any war or armed conflict in which the United
     7  States engaged and who was released from active duty under
     8  honorable conditions, other than from periods of active duty for
     9  training, or with an honorable discharge from such service, or a
    10  person who so served or after the effective date of this
    11  subsection serves in the armed forces of the United States, or
    12  in any women's organization officially connected therewith,
    13  since July 27, 1953, including service in Vietnam, and who has
    14  an honorable discharge from such service.
    15     Section 2.  This act shall take effect in 60 days.
