AN ACT 1 Amending Title 65 (Public Officers) of the Pennsylvania 2 Consolidated Statutes, further defining "public notice"; and 3 further providing for minutes of meetings. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. The definition of "public notice" in section 703 7 of Title 65 of the Pennsylvania Consolidated Statutes is amended 8 to read: 9 § 703. Definitions. 10 The following words and phrases when used in this chapter 11 shall have the meanings given to them in this section unless the 12 context clearly indicates otherwise: 13 * * * 14 "Public notice." 15 (1) For a meeting: 16 (i) Publication of notice of the place, date and 17 time of a meeting in a newspaper of general circulation,
1 as defined by 45 Pa.C.S. § 101 (relating to definitions), 2 which is published and circulated in the political 3 subdivision where the meeting will be held, or in a 4 newspaper of general circulation which has a bona fide 5 paid circulation in the political subdivision equal to or 6 greater than any newspaper published in the political 7 subdivision. 8 (ii) Posting a notice of the place, date and time of 9 a meeting prominently at the principal office of the 10 agency holding the meeting or at the public building in 11 which the meeting is to be held. 12 (iii) Giving notice to parties under section 709(c) 13 (relating to public notice). 14 (iv) Publication of notice of the place, date and 15 time of meeting on the agency's Internet website, if any. 16 (2) For a recessed or reconvened meeting: 17 (i) Posting a notice of the place, date and time of 18 the meeting prominently at the principal office of the 19 agency holding the meeting or at the public building in 20 which the meeting is to be held. 21 (ii) Giving notice to parties under section 709(c). 22 (iii) Posting notice of the place, date and time of 23 the meeting on the agency's Internet website, if any. 24 * * * 25 Section 2. Section 706 of Title 65 is amended to read: 26 § 706. Minutes of meetings, public records and recording of 27 meetings. 28 Written minutes shall be kept of all open meetings of 29 agencies and shall be accessible on the agency's Internet 30 website, if any. 1 (1) The date, time and place of the meeting. 2 (2) The names of members present. 3 (3) The substance of all official actions and a record 4 by individual member of the roll call votes taken. 5 (4) The names of all citizens who appeared officially 6 and the subject of their testimony. 7 Section 3.
