                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for mandatory prison
     3     sentences for arson and related offenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3301(b) and (c) of Title 18 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 3301.  Arson and related offenses.
     9     * * *
    10     (b)  Sentence.--A person convicted of violating the
    11  provisions of subsection (a)(2), murder of the first degree,
    12  shall be sentenced to death or life imprisonment without right
    13  to parole; a person convicted of murder of the second degree,
    14  pursuant to subsection (a)(2), shall be sentenced to life
    15  imprisonment without right to parole. Notwithstanding provisions
    16  to the contrary, no language herein shall infringe upon the
    17  inherent powers of the Governor to commute said sentence. A
    18  person convicted of violating subsection (a)(1) shall be

     1  sentenced to a mandatory minimum five-year term of imprisonment.
     2     (c)  Arson endangering property.--A person commits a felony
     3  of the second degree if he intentionally starts a fire or causes
     4  an explosion, whether on his own property or that of another, or
     5  if he aids, counsels, pays or agrees to pay another to cause a
     6  fire or explosion, and if:
     7         (1)  he commits the act with intent of destroying or
     8     damaging a building or unoccupied structure of another;
     9         (2)  he thereby recklessly places an inhabited building
    10     or occupied structure of another in danger of damage or
    11     destruction; or
    12         (3)  he commits the act with intent of destroying or
    13     damaging any property, whether his own or of another, to
    14     collect insurance for such loss.
    15  A person convicted of violating this subsection shall be
    16  sentenced to a mandatory minimum two-year term of imprisonment.

    18     Section 2.  This act shall take effect in 60 days.
