                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for mandatory testing for alcohol and
     3     drugs in certain cases.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3802.1.  Presumption of impairment.
     9     Absent evidence to the contrary, whenever a motor vehicle
    10  accident occurs resulting in a death or a life-threatening
    11  injury, the driver of any such vehicle shall be required to
    12  submit to testing to determine whether he has alcohol or another
    13  impairing substance in his system.
    14     Section 2.  This act shall take effect in 60 days.
