                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     further providing for the definition of "maximum annual
     8     income" and for PACENET eligibility.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The definition of "maximum annual income" in
    12  section 502 of the act of August 26, 1971 (P.L.351, No.91),
    13  known as the State Lottery Law, amended July 7, 2006 (P.L.1061,
    14  No.111), is amended to read:
    15  Section 502.  Definitions.
    16     The following words and phrases when used in this chapter
    17  shall have the meanings given to them in this section unless the


     1  context clearly indicates otherwise:
     2     * * *
     3     "Maximum annual income."  For PACE eligibility, the term
     4  shall mean annual income which shall not exceed [$14,500]
     5  $16,500 in the case of single persons nor [$17,700] $19,700 in
     6  the case of the combined annual income of persons married to
     7  each other. For PACENET eligibility, the term shall mean the
     8  annual income limits established under section 519. Persons may,
     9  in reporting income to the Department of Aging, round the amount
    10  of each source of income and the income total to the nearest
    11  whole dollar, whereby any amount which is less than 50¢ is
    12  eliminated.

    14     Section 2.  Section 519(b) of the act, amended July 7, 2006
    15  (P.L.1061, No.111), is amended to read:
    16  Section 519.  The Pharmaceutical Assistance Contract for the
    17                 Elderly Needs Enhancement Tier.

    19     (b)  PACENET eligibility.--A person with an annual income of
    20  not less than [$14,500] $16,500 and not more than [$23,500]
    21  $25,500 in the case of a single person and of not less than
    22  [$17,700] $19,700 and not more than [$31,500] $33,500 in the
    23  case of the combined income of persons married to each other
    24  shall be eligible for enhanced pharmaceutical assistance under
    25  this section. A person may, in reporting income to the
    26  department, round the amount of each source of income and the
    27  income total to the nearest whole dollar, whereby any amount
    28  which is less than 50¢ is eliminated.

    30     Section 3.  This act shall take effect in 60 days.
