                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for commercial driver's license
     3     qualification standards.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1607(b) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1607.  Commercial driver's license qualification standards.
     9     * * *
    10     (b)  Waiver of test.--The department shall waive the skills
    11  test specified in this section for a commercial driver's license
    12  applicant [holding]:
    13         (1)  Holding a valid Class 2, 3 or 4 license who meets
    14     the requirements of Federal regulations. If permitted by
    15     Federal regulation, the department may waive the written test
    16     requirement for a commercial driver's license applicant
    17     holding a valid Class 2, 3 or 4 license.

     1         (2)  Who, subject to the limitations and requirements of
     2     49 CFR 383.77 (relating to substitute for driving skills
     3     tests), meets all certifications required for waiver under 49
     4     CFR 383.77 and who certifies all of the following:
     5             (i)  That the applicant is a member of the active or
     6         reserve components of any branch or unit of the armed
     7         forces of the United States or a veteran who received an
     8         honorable discharge from any branch or unit of the active
     9         or reserve components of the armed forces of the United
    10         States or is or was employed by a United States
    11         Department of State or Department of Defense contractor
    12         supplementing military efforts in a foreign jurisdiction.
    13             (ii)  That the applicant is or was regularly employed
    14         in a position in the armed forces of the United States or
    15         in a position with a United States Department of State or
    16         Department of Defense contractor supplementing military
    17         efforts in a foreign jurisdiction requiring the operation
    18         of a commercial motor vehicle.
    19             (iii)  That the applicant has legally operated, for
    20         at least two years immediately preceding application for
    21         a commercial driver's license, a vehicle representative
    22         of the commercial motor vehicle the driver applicant
    23         operates or expects to operate, under the exemption from
    24         this Commonwealth's commercial driver's license
    25         requirement provided by section 1606(b)(2) (relating to
    26         requirement for commercial driver's license) or the
    27         equivalent exemption of another state, while on active
    28         duty in a foreign jurisdiction or while employed by a
    29         United States Department of State or Department of
    30         Defense contractor supplementing military efforts in a

     1         foreign jurisdiction.

     3     Section 2.  This act shall take effect in 60 days.
