                                     AN ACT

     1  Amending the act of December 12, 1994 (P.L.1023, No.139),
     2     entitled "An act establishing the Statewide Independent
     3     Living Council; providing for the powers and duties of the
     4     council; providing for a State plan for the provision of
     5     services to people with disabilities; providing for grants
     6     and funding for establishment of centers for independent
     7     living; and requiring centers for independent living to
     8     maintain certain standards and give certain assurances in
     9     order to qualify for assistance," further providing for the
    10     composition of the Statewide Independent Living Council.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 5(b) and (c)(1) of the act of December
    14  12, 1994 (P.L.1023, No.139), known as the Independent Living
    15  Services Act, are amended to read:
    16  Section 5.  Statewide Independent Living Council.

    18     (b)  Manner of appointment of members.--[Members] Except as
    19  provided in subsection (c)(1), members of the council shall be
    20  appointed by the Governor. The Governor shall select members

     1  from recommendations of representatives of organizations with
     2  governing boards in which at least 51% are persons with
     3  disabilities. The board shall be representative of a broad range
     4  of individuals with disabilities. The council shall be composed
     5  of members appointed to provide Statewide representation,
     6  represent a broad range of disabilities and ensure knowledge
     7  about centers for independent living and services and programs
     8  provided.
     9     (c)  Members.--
    10         (1)  The council shall include a majority of individuals
    11     with disabilities who are not State employees and [at least
    12     50%] seven of the directors of the centers for independent
    13     living within this Commonwealth, four of whom shall be chosen
    14     by [the] a consensus of all regional directors of centers for
    15     independent living in this Commonwealth and three of whom
    16     shall be chosen by the Governor in the manner set forth in
    17     paragraph (3).

    19     Section 2.  The amendment of section 5(c)(1) of the act shall
    20  apply to members chosen after the effective date of this act.
    21     Section 3.  This act shall take effect immediately.
